제8조 경매에 의한 임차권의 소멸

제8조(경매에 의한 임차권의 소멸) 임차권은 임차건물에 대하여 「민사집행법」에 따른 경매가 실시된 경우에는 그 임차건물이 매각되면 소멸한다. 다만, 보증금이 전액 변제되지 아니한 대항력이 있는 임차권은 그러하지 아니하다.

① The leasehold shall be extinguished when the leased building is sold, if an auction is conducted on the leased building in accordance with the 「Act on Civil Execution」. However, this shall not apply to a leasehold with priority over third parties, for which the security deposit has not been paid in full.
