Article 32 (Disqualifications for Permits and Registrations)

① No person falling under any of the following subparagraphs may obtain a permit or be registered under Articles 28, 29, and 33-3 (limited to subparagraph 6). <Amended by Act No. 9425, Feb. 29, 2008; Act No. XXXX, Dec. 16, 2025> 1. A juridical person whose registration has been canceled under Article 34 and whose period of one year has not elapsed since the date of cancellation, and a major shareholder (meaning a shareholder determined by Presidential Decree; hereinafter the same shall apply) of such juridical person who has not passed one year since the date of cancellation. 2. A juridical person whose permit or registration has been revoked under Article 43 (1) and whose period of three years has not elapsed since the date of revocation, and a major shareholder of such juridical person at the time of revocation who has not passed three years since the date of revocation. 3. A company undergoing rehabilitation proceedings under the Debtor Rehabilitation and Bankruptcy Act and a major shareholder of that company. 4. A person who has failed to repay debt by the agreed date in financial transactions or other commercial transactions, as determined by the Financial Services Commission. 5. A person who has received a penalty of a fine or a more severe punishment for violating financial-related laws and regulations determined by Presidential Decree within the three years prior to the date of application for a permit or registration. 6. A juridical person whose major shareholder falls under subparagraphs 1 through 5. In this case, when obtaining approval for a change or making a change in registration under Article 33-3, the "date of application for a permit or registration" in subparagraph 5 shall be deemed the "date of application for a change permit or change registration" under Article 33-3.
