제50조 양벌규정

법인의 대표자나 법인 또는 개인의 대리인, 사용인, 그 밖의 종업원이 그 법인 또는 개인의 업무에 관하여 제49조제1항, 제2항, 제3항(「형법」 제216조에서 정한 형으로 처벌하는 경우로 한정한다), 제4항부터 제7항까지의 어느 하나에 해당하는 위반행위를 하면 그 행위자를 벌하는 외에 그 법인 또는 개인에게도 해당 조문의 벌금형을 과(科)한다. 다만, 법인 또는 개인이 그 위반행위를 방지하기 위하여 해당 업무에 관하여 상당한 주의와 감독을 게을리하지 아니한 경우에는 그러하지 아니하다. <개정 2014.10.15, 2020.5.19>
If the representative of a legal person, or an agent, employee, or any other person engaged by a legal person or an individual, commits a violation specified in any of the following subparagraphs in relation to the business of such legal person or individual, the legal person or individual shall also be subject to the penalty of a fine as prescribed in the relevant article, in addition to the punishment of the offender: Article 49 (1), (2), (3) (limited to cases punished by the penalty prescribed in Article 216 of the Criminal Act), (4) through (7). Provided, however, that this shall not apply if the legal person or individual has not neglected to exercise due care and supervision regarding the relevant business in order to prevent the violation.
법인의 대표자나 법인 또는 개인의 대리인, 사용인, 그 밖의 종업원이 그 법인 또는 개인의 업무에 관하여 제49조제3항(「형법」 제214조, 제215조 또는 제217조에서 정한 형으로 처벌하는 경우로 한정한다)의 위반행위를 하면 그 행위자를 벌하는 외에 그 법인 또는 개인을 5천만원 이하의 벌금에 처한다. 다만, 법인 또는 개인이 그 위반행위를 방지하기 위하여 해당 업무에 관하여 상당한 주의와 감독을 게을리하지 아니한 경우에는 그러하지 아니하다. <개정 2014.10.15>
If the representative of a legal person, or an agent, employee, or any other person engaged by a legal person or an individual, commits a violation specified in Article 49 (3) (limited to cases punished by the penalty prescribed in Articles 214, 215, or 217 of the Criminal Act) in relation to the business of such legal person or individual, the legal person or individual shall be subject to a fine not exceeding 50 million won, in addition to the punishment of the offender. Provided, however, that this shall not apply if the legal person or individual has not neglected to exercise due care and supervision regarding the relevant business in order to prevent the violation.
