제180조 비거주자의 대리인 등의 범위

법 제120조제3항 각 호 외의 부분에서 "대통령령으로 정하는 자"란 다음 각 호의 어느 하나에 해당하는 자를 말한다. <개정 2010.2.18, 2019.2.12, 2026.2.27>
1. 비거주자의 자산을 상시 보관하고 관례적으로 이를 배달 또는 인도하는 자
2. 중개인, 일반위탁매매인 기타 독립적 지위의 대리인으로서 전적으로 또는 거의 전적으로 「국제조세조정에 관한 법률」 제2조제1항제3호에 따른 특수관계가 있는 비거주자를 위하여 계약체결등 사업에 관한 중요한 부분의 행위를 하는 자(이들이 자기사업의 정상적인 과정에서 활동하는 경우를 포함한다)
3. 보험사업(재보험사업은 제외한다)을 영위하는 비거주자를 위하여 보험료를 징수하거나 국내소재 피보험물에 대한 보험을 인수하는 자
In the part other than the subparagraphs of Article 120 (3) of the Act, "persons prescribed by Presidential Decree" means persons falling under any of the following subparagraphs. <Amended by Presidential Decree No. 21971, Feb. 18, 2010; Presidential Decree No. 29528, Feb. 12, 2019; Presidential Decree No. 33031, Feb. 27, 2026> 1. A person who permanently stores the assets of a non-resident and customarily delivers or transfers them. 2. An agent, such as a broker, general commission agent, or other agent of independent status, who, in whole or in large part, performs acts of a significant portion of business, including the conclusion of contracts, for a non-resident having a special relationship under Article 2 (1) 3 of the 「International Taxation Coordination Act」 (including cases where these persons act in the ordinary course of their own business). 3. A person who collects insurance premiums for a non-resident engaged in the insurance business (excluding reinsurance business), or who underwrites insurance for insured property located in Korea.
법 제120조제5항제1호 각 목 외의 부분에서 "대통령령으로 정하는 특수관계인"이란 제183조의2제2항 각 호의 어느 하나에 해당하는 관계에 있는 자를 말한다. <신설 2019.2.12>
In the part other than the items of Article 120 (5) 1 of the Act, "related person prescribed by Presidential Decree" means a person having a relationship falling under any of the subparagraphs of Article 183-2 (2). <Newly inserted by Presidential Decree No. 29528, Feb. 12, 2019>
