제91조 양도소득세 비과세 또는 감면의 배제 등

제104조제3항에서 규정하는 미등기양도자산에 대하여는 이 법 또는 이 법 외의 법률 중 양도소득에 대한 소득세의 비과세에 관한 규정을 적용하지 아니한다.
For unregistered transferred assets prescribed in Article 104(3), the provisions on non-taxation of capital gains under this Act or any other Act shall not apply.
제94조제1항제1호 및 제2호의 자산을 매매하는 거래당사자가 매매계약서의 거래가액을 실지거래가액과 다르게 적은 경우에는 해당 자산에 대하여 이 법 또는 이 법 외의 법률에 따른 양도소득세의 비과세 또는 감면에 관한 규정을 적용할 때 비과세 또는 감면받았거나 받을 세액에서 다음 각 호의 구분에 따른 금액을 뺀다.
1. 이 법 또는 이 법 외의 법률에 따라 양도소득세의 비과세에 관한 규정을 적용받을 경우: 비과세에 관한 규정을 적용하지 아니하였을 경우의 제104조제1항에 따른 양도소득 산출세액과 매매계약서의 거래가액과 실지거래가액과의 차액 중 적은 금액
2. 이 법 또는 이 법 외의 법률에 따라 양도소득세의 감면에 관한 규정을 적용받았거나 받을 경우: 감면에 관한 규정을 적용받았거나 받을 경우의 해당 감면세액과 매매계약서의 거래가액과 실지거래가액과의 차액 중 적은 금액
Where the parties to a transaction for the sale and purchase of assets referred to in Article 94(1) 1. and 2. record a transaction value different from the actual transaction value in the sales contract, the amount to be subtracted from the tax amount that has been exempted or reduced or will be exempted or reduced, when applying the provisions on non-taxation or reduction of capital gains tax under this Act or any other Act with respect to the relevant assets, shall be as follows: 1. In cases where the provisions on non-taxation are applied under this Act or any other Act: The lesser of the capital gains tax calculated under Article 104(1) if the provisions on non-taxation had not been applied, and the difference between the transaction value stated in the sales contract and the actual transaction value. 2. In cases where the provisions on reduction of capital gains tax have been applied or will be applied under this Act or any other Act: The lesser of the tax reduction amount in cases where the provisions on reduction have been applied or will be applied, and the difference between the transaction value stated in the sales contract and the actual transaction value.
