제8조 자격의 취득 시기 등

가입자는 국내에 거주하게 된 날에 직장가입자 또는 지역가입자의 자격을 얻는다. 다만, 다음 각 호의 어느 하나에 해당하는 사람은 그 해당되는 날에 각각 자격을 얻는다.
1. 수급권자이었던 사람은 그 대상자에서 제외된 날
2. 직장가입자의 피부양자이었던 사람은 그 자격을 잃은 날
3. 유공자등 의료보호대상자이었던 사람은 그 대상자에서 제외된 날
4. 제5조제1항제2호가목에 따라 보험자에게 건강보험의 적용을 신청한 유공자등 의료보호대상자는 그 신청한 날
A subscriber shall obtain the qualification of a workplace subscriber or a regional subscriber on the day they become a resident in Korea. However, a person falling under any of the following subparagraphs shall obtain the qualification on the day they fall under such category. 1. A person who was a beneficiary shall be excluded from the scope of beneficiaries on the day of exclusion. 2. A person who was a dependent of a workplace subscriber shall lose the qualification on the day of losing qualification. 3. A person who was a medical aid recipient among persons of merit, etc. shall be excluded from the scope of recipients on the day of exclusion. 4. A person of merit, etc. who is a medical aid recipient and has applied for health insurance coverage to the insurer pursuant to Article 5(1)(2)(a) shall obtain the qualification on the day of application.
제1항에 따라 자격을 얻은 경우 그 직장가입자의 사용자 및 지역가입자의 세대주는 그 명세를 보건복지부령으로 정하는 바에 따라 자격을 취득한 날부터 14일 이내에 보험자에게 신고하여야 한다.
Where a qualification is obtained pursuant to Paragraph ①, the employer of the workplace subscriber and the head of household of the regional subscriber shall report the details to the insurer within 14 days from the day the qualification is obtained, in accordance with the Ordinance of the Ministry of Health and Welfare.
