제17조 개인정보의 제공

개인정보처리자는 다음 각 호의 어느 하나에 해당되는 경우에는 정보주체의 개인정보를 제3자에게 제공(공유를 포함한다. 이하 같다)할 수 있다. <개정 2020.2.4, 2023.3.14>
1. 정보주체의 동의를 받은 경우
2. 제15조제1항제2호, 제3호 및 제5호부터 제7호까지에 따라 개인정보를 수집한 목적 범위에서 개인정보를 제공하는 경우
A personal information controller may provide personal information of the data subject to a third party (including sharing; hereinafter the same shall apply) in any of the following cases: <Amended by Act No. 17187, Feb. 4. 2020; Act No. 19235, Mar. 14. 2023> 1. Where consent has been obtained from the data subject. 2. Where personal information is provided within the scope of the purpose for which personal information was collected pursuant to Article 15 (1) 2, 3, and 5 through 7.
개인정보처리자는 제1항제1호에 따른 동의를 받을 때에는 다음 각 호의 사항을 정보주체에게 알려야 한다. 다음 각 호의 어느 하나의 사항을 변경하는 경우에도 이를 알리고 동의를 받아야 한다.
1. 개인정보를 제공받는 자
2. 개인정보를 제공받는 자의 개인정보 이용 목적
3. 제공하는 개인정보의 항목
4. 개인정보를 제공받는 자의 개인정보 보유 및 이용 기간
5. 동의를 거부할 권리가 있다는 사실 및 동의 거부에 따른 불이익이 있는 경우에는 그 불이익의 내용
When obtaining consent under paragraph (1) 1, the personal information controller shall inform the data subject of the following matters. If any of the following matters is changed, the personal information controller shall also inform the data subject and obtain consent: 1. The recipient of the personal information. 2. The purpose of use of the personal information by the recipient. 3. The items of personal information to be provided. 4. The period for retention and use of personal information by the recipient. 5. The fact that the data subject has the right to refuse consent and, if there are any disadvantages due to refusal of consent, the details of such disadvantages.

개인정보처리자는 당초 수집 목적과 합리적으로 관련된 범위에서 정보주체에게 불이익이 발생하는지 여부, 암호화 등 안전성 확보에 필요한 조치를 하였는지 여부 등을 고려하여 대통령령으로 정하는 바에 따라 정보주체의 동의 없이 개인정보를 제공할 수 있다. <신설 2020.2.4>
A personal information controller may provide personal information without the consent of the data subject, in accordance with the matters prescribed by Presidential Decree, considering whether disadvantages arise for the data subject within a scope reasonably related to the original collection purpose and whether measures necessary for securing safety, such as encryption, have been taken. <Newly Inserted by Act No. 17187, Feb. 4. 2020>
