제41조(위원의 신분보장) 위원은 자격정지 이상의 형을 선고받거나 심신상의 장애로 직무를 수행할 수 없는 경우를 제외하고는 그의 의사에 반하여 면직되거나 해촉되지 아니한다.
Translation
① A member shall not be dismissed or removed against their will, except when sentenced to suspension of qualification or a heavier punishment, or when unable to perform duties due to mental or physical disability. ② The provisions of paragraph ① shall apply mutatis mutandis to the dismissal or removal of members. ③ Members who have been dismissed or removed contrary to the provisions of paragraph ① may claim reinstatement and compensation for damages.
