1. 판결이 확정된 후 그 사안과 관련하여 국가ㆍ지방자치단체 또는 국가ㆍ지방자치단체가 설립한 기관에 의하여 새로운 증거가 나타난 경우
2. 기각판결이 원고의 고의로 인한 것임이 밝혀진 경우
