제158조의2(형의 감면) 긴급자동차(제2조제22호가목부터 다목까지의 자동차와 대통령령으로 정하는 경찰용 자동차만 해당한다)의 운전자가 그 차를 본래의 긴급한 용도로 운행하는 중에 교통사고를 일으킨 경우에는 그 긴급활동의 시급성과 불가피성 등 정상을 참작하여 제151조, 「교통사고처리 특례법」 제3조제1항 또는 「특정범죄 가중처벌 등에 관한 법률」 제5조의13에 따른 형을 감경하거나 면제할 수 있다. <개정 2021.1.12>

① Where the driver of an emergency vehicle (limited to vehicles under Article 2, Subparagraph 22, Items (a) through (c) and police vehicles prescribed by Presidential Decree) causes a traffic accident while operating such vehicle for its original emergency purpose, the punishment prescribed by Article 151, Article 3(1) of the 「Act on Special Cases Concerning the Settlement of Traffic Accidents」, or Article 5-13 of the 「Act on the Aggravated Punishment, etc. of Specific Crimes」 may be reduced or exempted, taking into account the urgency and unavoidability of the emergency activities, etc. <Amended by Act No. 17940, Jan. 12, 2021>
