제40조(정비불량차의 운전 금지) 모든 차의 사용자, 정비책임자 또는 운전자는 「자동차관리법」, 「건설기계관리법」이나 그 법에 따른 명령에 의한 장치가 정비되어 있지 아니한 차(이하 "정비불량차"라 한다)를 운전하도록 시키거나 운전하여서는 아니 된다.

① All users, persons responsible for maintenance, or drivers of vehicles shall not order or drive a vehicle whose device is not maintained in accordance with the 「Automobile Management Act」, the 「Construction Machinery Management Act」, or orders under these Acts (hereinafter referred to as 'poorly maintained vehicle').
