Article 41 (Inspection of Vehicles in Poor Repair)
제41조 정비불량차의 점검

경찰공무원은 정비불량차에 해당한다고 인정하는 차가 운행되고 있는 경우에는 우선 그 차를 정지시킨 후, 운전자에게 그 차의 자동차등록증 또는 자동차 운전면허증을 제시하도록 요구하고 그 차의 장치를 점검할 수 있다.
When a police officer recognizes that a vehicle that falls under the category of a vehicle in poor repair is being operated, the police officer may first stop the vehicle, then request the driver to present the vehicle registration certificate or driver's license, and inspect the vehicle's devices.
경찰공무원은 제1항에 따라 점검한 결과 정비불량 사항이 발견된 경우에는 그 정비불량 상태의 정도에 따라 그 차의 운전자로 하여금 응급조치를 하게 한 후에 운전을 하도록 하거나 도로 또는 교통 상황을 고려하여 통행구간, 통행로와 위험방지를 위한 필요한 조건을 정한 후 그에 따라 운전을 계속하게 할 수 있다.
If, as a result of the inspection conducted pursuant to Paragraph ①, defects in repair are found, the police officer may allow the driver to make emergency repairs depending on the degree of the poor repair condition before allowing operation, or may determine the driving section, driving route, and necessary conditions for preventing danger, considering the road or traffic conditions, and then allow continued operation accordingly.
시ㆍ도경찰청장은 제2항에도 불구하고 정비 상태가 매우 불량하여 위험발생의 우려가 있는 경우에는 그 차의 자동차등록증을 보관하고 운전의 일시정지를 명할 수 있다. 이 경우 필요하면 10일의 범위에서 정비기간을 정하여 그 차의 사용을 정지시킬 수 있다. <개정 2020.12.22>
The Commissioner of a Metropolitan Police Agency may, notwithstanding Paragraph ②, if the repair condition is extremely poor and there is a concern of danger occurring, retain the vehicle registration certificate and order the temporary suspension of operation. In such cases, if deemed necessary, the police officer may order the suspension of the vehicle's use by setting a repair period within the scope of 10 days. <Amended by Presidential Decree No. 31322, Dec. 22, 2020>
제1항부터 제3항까지의 규정에 따른 장치의 점검 및 사용의 정지에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the inspection of devices and the suspension of use pursuant to Paragraphs ① through ③ shall be determined by Presidential Decree.
