①

자동차등을 운전하려는 사람은 시ㆍ도경찰청장으로부터 운전면허를 받아야 한다. 다만, 제2조제19호나목의 원동기를 단 차 중 「교통약자의 이동편의 증진법」 제2조제1호에 따른 교통약자가 최고속도 시속 20킬로미터 이하로만 운행될 수 있는 차를 운전하는 경우에는 그러하지 아니하다. <개정 2020.6.9, 2020.12.22, 2021.1.12>

Any person who intends to drive a motor vehicle, etc. shall obtain a driver's license from the head of the provincial police agency. However, this shall not apply to cases where a person with a disability, as defined in Article 2, subparagraph 1 of the 「Act on the Promotion of Mobility of Persons with Disabilities」, drives a motor vehicle with an engine, as defined in Article 2, subparagraph 19(b), which can only be operated at a maximum speed of 20 kilometers per hour or less. <Amended by Act No. 17251, Jun. 9, 2020; Act No. 17772, Dec. 22, 2020; Act No. 17841, Jan. 12, 2021>

시ㆍ도경찰청장은 운전을 할 수 있는 차의 종류를 기준으로 다음 각 호와 같이 운전면허의 범위를 구분하고 관리하여야 한다. 이 경우 운전면허의 범위에 따라 운전할 수 있는 차의 종류는 행정안전부령으로 정한다. <개정 2013.3.23, 2014.11.19, 2016.1.27, 2017.7.26, 2020.12.22>

    2. 나. 보통면허

The head of the provincial police agency shall classify and manage the scope of driver's licenses according to the types of vehicles that can be driven, as listed in the following subparagraphs. 시ㆍ도경찰청장은 운전면허를 받을 사람의 신체 상태 또는 운전 능력에 따라 행정안전부령으로 정하는 바에 따라 운전할 수 있는 자동차등의 구조를 한정하는 등 운전면허에 필요한 조건을 붙일 수 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2020.6.9, 2020.12.22, 2021.1.12>

시ㆍ도경찰청장은 제87조 및 제88조에 따라 적성검사를 받은 사람의 신체 상태 또는 운전 능력에 따라 제3항에 따른 조건을 새로 붙이거나 바꿀 수 있다. <개정 2020.12.22>

The head of the provincial police agency may newly attach or change the conditions referred to in paragraph ③ based on the physical condition or driving ability of a person who has undergone a medical examination pursuant to Articles 87 and 88. <Amended by Act No. 17772, Dec. 22, 2020>
