제94조의2(범죄경력조회 및 수사경력조회) 시ㆍ도경찰청장은 제82조제2항 각 호의 어느 하나의 경우에 해당하는 사람이 운전면허 결격사유가 된 법률 위반과 관련하여 같은 항 단서에 해당하는 확정판결 또는 처분을 받았는지 여부와 제93조제1항 또는 제2항에 따라 운전면허가 취소ㆍ정지된 사람이 그 처분의 원인이 된 법률 위반과 관련하여 무죄의 확정판결 또는 불기소처분을 받았는지 여부를 확인하기 위하여 「형의 실효 등에 관한 법률」 제6조에 따른 범죄경력조회 및 수사경력조회를 할 수 있다.

① The Metropolitan Police Agency Commissioner may conduct criminal record and investigation record inquiries pursuant to Article 6 of the 「Act on the Effectuation of Criminal Sentences, etc.」 to confirm whether a person falling under any of the subparagraphs of Article 82, Paragraph 2 has received a confirmed judgment or disposition falling under the proviso of the same paragraph in relation to the violation of law that became a disqualification for a driver's license, and whether a person whose driver's license has been revoked or suspended pursuant to Article 93, Paragraph 1 or 2 has received a confirmed judgment of not guilty or a disposition of non-prosecution in relation to the violation of law that became the cause of the disposition.
