국세청장(지방국세청장을 포함한다. 이하 이 조에서 같다)은 납세지 관할 세무서장이 근로장려금의 결정 또는 경정을 위하여 신청자 및 그 밖의 가구원의 금융거래의 내용에 관하여 확인이 필요한 경우에는 「금융실명거래 및 비밀보장에 관한 법률」 제4조에도 불구하고 대통령령으로 정하는 바에 따라 문서 또는 「국세기본법」 제2조제18호에 따른 정보통신망(이하 이 조에서 "정보통신망"이라 한다)으로 금융회사등의 장에게 금융거래의 내용에 관한 자료를 요구할 수 있으며, 해당 금융회사등의 장은 정보통신망으로 전송하거나 디스켓 또는 자기테이프 등 전자기록매체 등으로 제출하여야 한다. <개정 2011.7.14, 2014.1.1, 2016.12.20>
The Commissioner of the National Tax Service (including the Commissioner of a Regional National Tax Office; hereinafter the same in this Article) may, if the head of the tax office having jurisdiction over the place of tax payment deems it necessary to verify the financial transaction details of an applicant and other household members for the determination or correction of the earned income tax credit, request data on the financial transaction details from the head of a financial company, etc. via documents or the information and communication network as defined in Article 2, Item 18 of the 「National Tax Basic Act」 (hereinafter referred to as the "information and communication network" in this Article), notwithstanding Article 4 of the 「Act on Disclosure of Financial Transaction Information and Protection of Financial Information」, pursuant to what is provided for by Presidential Decree, and the head of the financial company, etc. shall submit such data via the information and communication network or through electronic recording media such as diskettes or magnetic tapes. <Amended by Act No. 10885, Jul. 14, 2011, Act No. 12207, Jan. 1, 2014, Act No. 14450, Dec. 20, 2016>
국세청장은 제1항에 따라 제출받은 자료를 제1항의 목적 외의 용도로 사용하거나 다른 기관에 제공하여서는 아니 된다.
The Commissioner of the National Tax Service shall not use the data submitted under paragraph ① for any purpose other than that specified in paragraph ①, nor shall such data be provided to other institutions.
