제115조 주세의 면제

다음 각 호의 어느 하나에 해당하는 주류에 대해서는 주세를 면제한다. <개정 2020.12.29>
1. 「관광진흥법」 제3조제1항제3호에 따른 관광객 이용시설업 중 주한외국군인 및 외국인선원 전용 유흥음식점업을 경영하는 자가 해당 음식점에서 제공하는 주류
2. 제107조에 따른 외국인관광객 등이 다음 각 목의 어느 하나에 해당하는 주류 제조장을 방문하여 구매하는 주류(방문한 주류 제조장에서 제조한 것으로 한정한다)
- 가. 대통령령으로 정하는 소규모 주류 제조장
- 나. 「주세법」 제2조제8호에 따른 전통주를 제조하는 주류 제조장
Liquor tax shall be exempted for liquor falling under any of the following subparagraphs. <Amended by Act No. 17854, Dec. 29, 2020> 1. Liquor provided at restaurants for entertainment facilities for foreign military personnel stationed in Korea and foreign sailors, among entertainment and food service businesses under Article 3 (1) 3 of the Tourism Promotion Act, operated by a person managing such businesses. 2. Liquor purchased by foreign tourists, etc. under Article 107 upon visiting liquor manufacturing facilities falling under any of the following sub-paragraphs (limited to liquor manufactured at the liquor manufacturing facility visited): Provided, That this shall be limited to liquor manufactured at the liquor manufacturing facility visited. a. Small-scale liquor manufacturing facilities prescribed by Presidential Decree. b. Liquor manufacturing facilities manufacturing traditional liquor under Article 2 (8) of the Liquor Tax Act.
제1항에 따라 면세되는 주류의 원료용 주류의 주세액에 상당하는 금액은 환급하거나 공제하되, 이에 관하여는 「주세법」 제19조제3항을 준용한다. <개정 2021.12.28>
The amount equivalent to the liquor tax on liquor used as raw materials for liquor exempted under Paragraph ① shall be refunded or deducted, and Article 19 (3) of the Liquor Tax Act shall apply mutatis mutandis thereto. <Amended by Act No. 18631, Dec. 28, 2021>
제1항에 따른 주세의 면제절차는 「주세법」 제20조를 준용한다. <개정 2021.12.28>
The procedures for exemption from liquor tax under Paragraph ① shall apply mutatis mutandis to Article 20 of the Liquor Tax Act. <Amended by Act No. 18631, Dec. 28, 2021>
