Article 25-8 (Tax Credit for Webtoon Content Production Costs)
제25조의8 웹툰콘텐츠 제작비용에 대한 세액공제

대통령령으로 정하는 내국인이 2028년 12월 31일까지 「만화진흥에 관한 법률」 제2조제5호의2에 따른 웹툰 등 대통령령으로 정하는 웹툰콘텐츠(이하 이 조에서 "웹툰콘텐츠"라 한다)의 제작을 위하여 국내에서 발생한 비용 중 대통령령으로 정하는 비용(이하 이 조에서 "웹툰콘텐츠 제작비용"이라 한다)이 있는 경우에는 해당 웹툰콘텐츠 제작비용의 100분의 10(중소기업의 경우에는 100분의 15)에 상당하는 금액을 대통령령으로 정하는 바에 따라 해당 웹툰콘텐츠가 처음으로 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제1호에 따른 정보통신망에 공개된 과세연도의 소득세(사업소득에 대한 소득세만 해당한다) 또는 법인세에서 공제한다.
Where a domestic entity, as prescribed by Presidential Decree, incurs costs that arise within the Republic of Korea for the production of webtoon content, such as webtoons prescribed by Article 2, Item 5-2 of the Promotion of Comic Promotion Act, as prescribed by Presidential Decree (hereinafter referred to as "webtoon content" in this Article), among costs prescribed by Presidential Decree (hereinafter referred to as "webtoon content production costs" in this Article), by December 31, 2028, an amount equivalent to 10 percent (15 percent in the case of small and medium-sized enterprises) of such webtoon content production costs shall be deducted from the income tax (limited to income tax on business income) or corporate tax for the taxation year in which such webtoon content is first disclosed on an information and communications network as prescribed by Article 2, Item 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., in accordance with Presidential Decree.
제1항을 적용받으려는 내국인은 대통령령으로 정하는 바에 따라 세액공제신청을 하여야 한다.
A domestic entity wishing to apply Paragraph ① shall file a tax credit application as prescribed by Presidential Decree.
제1항을 적용할 때 웹툰콘텐츠의 범위, 웹툰콘텐츠 제작비용의 계산방법, 그 밖에 필요한 사항은 대통령령으로 정한다.
When applying Paragraph ①, the scope of webtoon content, the calculation method for webtoon content production costs, and other necessary matters shall be prescribed by Presidential Decree.
