제29조의2 산업수요맞춤형고등학교등 졸업자를 병역 이행 후 복직시킨 기업에 대한 세액공제

중소기업 또는 중견기업이 산업수요맞춤형고등학교등을 졸업한 사람 중 대통령령으로 정하는 사람을 고용한 경우 그 근로자가 대통령령으로 정하는 병역을 이행한 후 2020년 12월 31일까지 복직된 경우(병역을 이행한 후 1년 이내에 복직된 경우만 해당한다)에는 해당 복직자에게 복직일 이후 2년 이내에 지급한 대통령령으로 정하는 인건비의 100분의 30(중견기업의 경우에는 100분의 15)에 상당하는 금액을 해당 과세연도의 소득세(사업소득에 대한 소득세만 해당한다) 또는 법인세에서 공제한다. <개정 2017.12.19, 2020.12.29>
If a small or medium-sized enterprise or a medium-sized enterprise hires a person who has graduated from an industry-demand customized high school, etc., and such person is re-employed after fulfilling military service, as prescribed by Presidential Decree, by December 31, 2020 (limited to cases where re-employment occurs within one year after fulfilling military service), an amount equivalent to 30 percent (15 percent in the case of a medium-sized enterprise) of the labor costs paid to such re-employed person within two years after the date of re-employment, as prescribed by Presidential Decree, shall be deducted from the income tax (limited to income tax on business income) or corporate tax for the relevant tax year. <Amended by Act No. 14469, Dec. 19, 2017; Act No. 17845, Dec. 29, 2020>
제1항을 적용받으려는 중소기업 또는 중견기업은 대통령령으로 정하는 바에 따라 세액공제신청을 하여야 한다. <개정 2017.12.19>
