Article 23 (Request for Cooperation from Relevant Agencies, etc.)

The Minister of Employment and Labor may request the provision of data or the use of relevant computer networks (hereinafter referred to as "provision of data, etc.") to the persons falling under each of the following subparagraphs, for the purpose of performing duties under this Act, such as the payment of advance payment under Article 7 or Article 7-2, the loan of unpaid wages, etc. and living expenses under Article 7-3, the subrogation of claims for unpaid wages, etc. under Article 8, the confirmation of unpaid wages, etc. under Article 12, or the recovery of unjust enrichment under Article 14. The President of the Court Administration Office shall be requested to provide certificates of registered matters concerning buildings, certificates of registered matters concerning land, certificates of registered matters concerning corporations, and data on deposited money paid in accordance with Article 4 of the Act on Deposits (hereinafter referred to as "defaulting employers, etc.") of defaulting employers, persons of unjust enrichment, and persons jointly and severally liable (hereinafter referred to as "defaulting employers, etc."). 2. The Minister of the Interior and Safety shall be requested to provide a copy of resident registration of defaulting employers, etc. 3. The Minister of Land, Infrastructure and Transport shall be requested to provide data on real estate, automobiles, construction machinery, aircraft, yachts, etc. (including registration books) in the name of defaulting employers, etc. 3-2. The Minister of Oceans and Fisheries shall be requested to provide data on vessels (including registration books) in the name of defaulting employers, etc. 3-3. The heads of relevant central administrative agencies or the heads of supervised mutual aid cooperatives shall be requested to provide data on securities held in the name of defaulting employers, etc. 4. The Commissioner of the National Tax Service shall be requested to provide data on golf (condominium) memberships, intellectual property rights (patents, copyrights, etc.), calligraphy, antiques, goodwill, and business registration (referring to business registration under Article 8 of the Value-Added Tax Act, Article 168 of the Income Tax Act, and Article 111 of the Corporate Tax Act) in the name of defaulting employers, etc. 5. The heads of local governments shall be requested to provide family relationship registration documents (certificates of family relationship, certificates of marriage, basic certificates), certificates of local tax assessment on assets, general (collective) building registers, land (forest) registers, registration of rights such as leasehold, deposit, and provisional seizure in the name of defaulting employers, etc., and tax data on registration and license tax related thereto. 6. The President of the Korea Legal Aid Corporation, established under Article 8 of the Act on Legal Aid, shall be requested to provide documents related to civil litigation procedures, such as lawsuits, preservation measures, and compulsory execution concerning unpaid wages, etc. between workers and defaulting employers, etc. (including documents such as complaints, applications, judgments, and decisions). 7. The President of the National Health Insurance Service, established under Article 13 of the National Health Insurance Act, shall be requested to provide data on premiums paid for health insurance, national pension, industrial accident compensation insurance, and employment insurance for defaulting employers, etc. (including arrears) and medical benefit costs claimed by medical institutions that are defaulting employers, etc. under Article 47 of the National Health Insurance Act. 7-2. The Korea Workers' Compensation and Welfare Service, established under Article 10 of the Industrial Accident Compensation Insurance Act, shall be requested to provide data on defaulting employers, etc. and workers who have claimed advance payment, as follows: a. Data on acquisition of insured status under Article 13 of the Employment Insurance Act. b. Data on reporting of insured status under Article 15 of the Employment Insurance Act. c. Data on the establishment and termination of employment and industrial accident insurance relations under Articles 7 and 10 of the Act on the Collection of Employment and Industrial Accident Insurance Premiums (including addresses and phone numbers of defaulting employers, etc.). d. Data on the calculation of monthly insurance premiums for individual workers under Article 16-3 of the Act on the Collection of Employment and Industrial Accident Insurance Premiums. e. Data on reporting of employment and termination of employment relations of workers under paragraphs 3 and 4 of Article 16-10 of the Act on the Collection of Employment and Industrial Accident Insurance Premiums. f. Data on the adjustment and refund of overpaid insurance premiums, etc. under Article 23 of the Act on the Collection of Employment and Industrial Accident Insurance Premiums. g. Data on medical expenses claimed under Article 45 of the Industrial Accident Compensation Insurance Act (limited to cases where defaulting employers, etc. are medical institutions under Article 43 of the Industrial Accident Compensation Insurance Act). h. Data on participation in the retirement pension system for small and medium-sized enterprises, period of participation, accumulated amount or contribution amount, payment amount, etc. under subparagraph 14 of Article 2 of the Act on the Guarantee of Retirement Benefits for Workers (limited to the period for which advance payment is to be paid). 7-3. The Korea Employment Information Service, established under Article 18 of the Basic Act on Employment Policy, shall be requested to provide data on defaulting employers, etc. and workers who have claimed advance payment, as follows: a. Data on support under Articles 20 through 23 of the Employment Insurance Act. b. Data on unemployment reporting and recognition of unemployment under Articles 42 and 44 of the Employment Insurance Act. c. Data on maternity leave benefits, etc. under Article 75 of the Employment Insurance Act. 8. Retirement pension providers established under Article 26 of the Act on the Guarantee of Retirement Benefits for Workers shall be requested to provide information on retirement pensions, including whether workers claiming advance payment have joined a retirement pension plan, the period of participation, the accumulated amount or contribution amount, and the payment amount (limited to the period for which advance payment is to be paid). 9. Insurance companies established under the Insurance Business Act shall be requested to provide information on whether foreign workers claiming advance payment have joined departure guarantee insurance, trusts, and guarantee insurance, and data on premiums paid (limited to information for the period for which advance payment is to be paid). 10. The Governor of the Credit Guarantee Fund, established under Article 4 of the Credit Guarantee Fund Act, and the Governor of the Korea Technology Finance Corporation, established under Article 12 of the Korea Technology Finance Corporation Act, shall be requested to provide data on the establishment of pledge and mortgage rights in the name of defaulting employers, etc. 11. Persons licensed to provide guarantee insurance under subparagraph 2(d) of Article 4(1) of the Insurance Business Act shall be requested to provide data on the establishment of pledge and mortgage rights in the name of defaulting employers, etc. 12. The Administrator of the Public Procurement Service shall be requested to provide contract-related information of defaulting employers, etc. managed under paragraph 1 of Article 16 of the Act on the Use and Promotion of Electronic Procurement.

Fees and usage charges, etc. shall be exempted for the data provided under paragraph 1. <Newly added by Act No. 13979, Jan. 27, 2016>
