제42조 외국인등록증의 재발급

체류지 관할 청장ㆍ사무소장 또는 출장소장은 외국인등록증을 발급받은 사람에게 다음 각 호의 어느 하나에 해당하는 사유가 있으면 외국인등록증을 재발급할 수 있다. <개정 2018.5.8>
1. 외국인등록증을 분실한 경우
2. 외국인등록증이 헐어서 못 쓰게 된 경우
3. 외국인등록증의 적는 난이 부족한 경우
4. 법 제24조에 따라 체류자격 변경허가를 받은 경우
5. 법 제35조제1호의 사항에 대한 외국인등록사항 변경신고를 받은 경우
6. 위조방지 등을 위하여 외국인등록증을 한꺼번에 갱신할 필요가 있는 경우
The head of the immigration office, the head of the branch office, or the head of the field office having jurisdiction over the place of sojourn may reissue an alien registration card to a person who has received an alien registration card if any of the following subparagraphs apply: <Amended on May 8, 2018> 1. In case the alien registration card is lost. 2. In case the alien registration card is worn out and cannot be used. 3. In case there is insufficient space for entries on the alien registration card. 4. In case permission to change the status of stay has been granted under Article 24 of the Act. 5. In case a report of change in alien registration details under subparagraph 1 of Article 35 of the Act has been received. 6. In case it is necessary to renew the alien registration card all at once for reasons such as preventing forgery.
제1항에 따라 외국인등록증을 재발급받으려는 사람은 외국인등록증 재발급 신청서에 사진 1장을 첨부하여 체류지 관할 청장ㆍ사무소장 또는 출장소장에게 제출해야 한다. 이 경우 제1항제2호부터 제6호까지 규정된 사유로 외국인등록증의 재발급 신청을 할 때에는 그 신청서에 원래의 외국인등록증을 첨부하여야 한다. <개정 2018.5.8, 2020.2.18>
A person who intends to have an alien registration card reissued under paragraph ① shall submit an application for reissuance of the alien registration card, attached with one photograph, to the head of the immigration office, the head of the branch office, or the head of the field office having jurisdiction over the place of sojourn. In this case, when applying for reissuance of the alien registration card for the reasons prescribed in subparagraphs 2 through 6 of paragraph ①, the original alien registration card shall be attached to the application. <Amended on May 8, 2018, Feb. 18, 2020>
체류지 관할 청장ㆍ사무소장 또는 출장소장은 외국인등록증을 재발급할 때에는 그 사유를 외국인등록증 발급대장에 적고, 제2항 후단에 따라 받은 외국인등록증은 파기한다. <개정 2018.5.8>
When reissuing an alien registration card, the head of the immigration office, the head of the branch office, or the head of the field office having jurisdiction over the place of sojourn shall record the reason in the alien registration card issuance ledger and destroy the original alien registration card received under the latter part of paragraph ②. <Amended on May 8, 2018>
