제25조의2 전용용기 제조업

전용용기 제조를 업(이하 "전용용기 제조업"이라 한다)으로 하려는 자는 기후에너지환경부령으로 정하는 기준에 따른 시설ㆍ장비 등의 요건을 갖추어 기후에너지환경부장관에게 등록하여야 하며, 등록한 사항 중 기후에너지환경부령으로 정하는 중요한 사항을 변경하려는 경우에는 변경등록을 하여야 하고, 그 밖의 사항 중 기후에너지환경부령으로 정하는 사항을 변경하려면 변경신고를 하여야 한다. <개정 2025.10.1>
A person who intends to engage in the business of manufacturing special containers (hereinafter referred to as “special container manufacturing business”) shall register with the Minister of Climate, Energy and Environment after meeting the requirements for facilities, equipment, etc., in accordance with the standards prescribed by the Ordinance of the Minister of Climate, Energy and Environment. If he/she intends to change the important matters prescribed by the Ordinance of the Minister of Climate, Energy and Environment among the registered matters, he/she shall make a change registration, and if he/she intends to change other matters prescribed by the Ordinance of the Minister of Climate, Energy and Environment, he/she shall make a change report. <Amended on October 1, 2025>
기후에너지환경부장관은 제1항에 따른 변경신고를 받은 날부터 20일 이내에 변경신고수리 여부를 신고인에게 통지하여야 한다. <신설 2017.4.18, 2025.10.1>
The Minister of Climate, Energy and Environment shall notify the person who filed the change report of whether to accept the change report within 20 days from the date of receiving the change report. <Newly established on April 18, 2017, Amended on October 1, 2025>
기후에너지환경부장관이 제2항에서 정한 기간 내에 변경신고수리 여부나 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간이 끝난 날의 다음 날에 변경신고를 수리한 것으로 본다. <신설 2017.4.18, 2025.10.1>
If the Minister of Climate, Energy and Environment does not notify the person who filed the change report of whether to accept the change report or the extension of the processing period under the laws on civil petition processing within the period prescribed in paragraph ②, the change report shall be deemed to have been accepted on the day following the expiration of the period. <Newly established on April 18, 2017, Amended on October 1, 2025>
제1항에 따른 등록ㆍ변경등록 또는 변경신고의 절차 등에 관하여 필요한 사항은 기후에너지환경부령으로 정한다. <개정 2017.4.18, 2025.10.1>
Matters necessary for the procedures of registration, change registration, or change report under paragraph ① shall be prescribed by the Ordinance of the Minister of Climate, Energy and Environment. <Amended on April 18, 2017, October 1, 2025>
제1항에 따라 등록을 한 자(이하 "전용용기 제조업자"라 한다)가 제조할 수 있는 전용용기의 구조ㆍ규격ㆍ품질 및 표시에 관한 기준 등에 관하여 필요한 사항은 기후에너지환경부령으로 정한다. <개정 2017.4.18, 2025.10.1>
Matters necessary for the standards regarding the structure, specifications, quality, and labeling of special containers that may be manufactured by a person who has registered under paragraph ① (hereinafter referred to as “special container manufacturer”) shall be prescribed by the Ordinance of the Minister of Climate, Energy and Environment. <Amended on April 18, 2017, October 1, 2025>
전용용기 제조업자는 제조한 전용용기의 구조ㆍ규격ㆍ품질 및 표시가 제5항에 따른 기준에 적합한지 여부에 대하여 기후에너지환경부령으로 정하는 바에 따라 검사를 받아야 한다. 이 경우 검사기관, 검사방법 및 절차 등에 관하여 필요한 사항은 기후에너지환경부령으로 정한다. <개정 2017.4.18, 2025.10.1>
A special container manufacturer shall undergo an inspection according to the standards prescribed by the Ordinance of the Minister of Climate, Energy and Environment to determine whether the structure, specifications, quality, and labeling of the manufactured special containers comply with the standards under paragraph ⑤. In this case, matters necessary for the inspection agency, inspection methods, and procedures shall be prescribed by the Ordinance of the Minister of Climate, Energy and Environment. <Amended on April 18, 2017, October 1, 2025>
전용용기 제조업자는 다른 사람에게 자기의 성명이나 상호를 사용하여 전용용기를 제조하게 하거나 그 등록증을 빌려주어서는 아니 된다. <개정 2017.4.18>
A special container manufacturer shall not allow another person to manufacture special containers using his/her name or trade name, or lend his/her registration certificate to another person. <Amended on April 18, 2017>
전용용기 제조업자는 제5항에 따른 기준에 적합한 전용용기를 제조하는 등 기후에너지환경부령으로 정하는 준수사항을 지켜야 한다. <개정 2017.4.18, 2025.10.1>
A special container manufacturer shall comply with the matters to be observed prescribed by the Ordinance of the Minister of Climate, Energy and Environment, such as manufacturing special containers that comply with the standards under paragraph ⑤. <Amended on April 18, 2017, October 1, 2025>
