상가건물 임대차에 관한 다음 각 호의 사항을 심의하기 위하여 법무부에 상가건물임대차위원회(이하 "위원회"라 한다)를 둔다.

1. 제2조제1항 단서에 따른 보증금액
2. 제14조에 따라 우선변제를 받을 임차인 및 보증금 중 일정액의 범위와 기준

A Committee on Commercial Building Leases (hereinafter referred to as the "Committee") shall be established in the Ministry of Justice to deliberate on the following matters concerning commercial building leases. 1. The amount of deposits under the proviso of Article 2 (1). 2. The scope and standards of lessees entitled to preferential repayment and a certain amount of deposits under Article 14.

위원회는 위원장 1명을 포함한 10명 이상 15명 이하의 위원으로 성별을 고려하여 구성한다.

The Committee shall be composed of a chairperson and not less than 10 and not more than 15 members, considering gender.

위원회의 위원장은 법무부차관이 된다.

The chairperson of the Committee shall be the Vice Minister of Justice.

위원회의 위원은 다음 각 호의 어느 하나에 해당하는 사람 중에서 위원장이 임명하거나 위촉하되, 제1호부터 제6호까지에 해당하는 위원을 각각 1명 이상 임명하거나 위촉하여야 하고, 위원 중 2분의 1 이상은 제1호ㆍ제2호 또는 제7호에 해당하는 사람을 위촉하여야 한다. <개정 2025.10.1>

1. 법학ㆍ경제학 또는 부동산학 등을 전공하고 상가건물 임대차 관련 전문지식을 갖춘 사람으로서 공인된 연구기관에서 조교수 이상 또는 이에 상당하는 직에 5년 이상 재직한 사람
2. 변호사ㆍ감정평가사ㆍ공인회계사ㆍ세무사 또는 공인중개사로서 5년 이상 해당 분야에서 종사하고 상가건물 임대차 관련 업무경험이 풍부한 사람
3. 재정경제부에서 물가 관련 업무를 담당하는 고위공무원단에 속하는 공무원
4. 법무부에서 상가건물 임대차 관련 업무를 담당하는 고위공무원단에 속하는 공무원(이에 상당하는 특정직공무원을 포함한다)
5. 국토교통부에서 상가건물 임대차 관련 업무를 담당하는 고위공무원단에 속하는 공무원
6. 중소벤처기업부에서 소상공인 관련 업무를 담당하는 고위공무원단에 속하는 공무원
7. 그 밖에 상가건물 임대차 관련 학식과 경험이 풍부한 사람으로서 대통령령으로 정하는 사람

The members of the Committee shall be appointed or recommended by the chairperson from among persons falling under any of the following subparagraphs. The chairperson shall appoint or recommend at least one person from each of subparagraphs 1 through 6, and at least one-half of the members shall be persons falling under subparagraphs 1, 2, or 7. <Amended on October 1, 2025> 1. Persons who have majored in law, economics, or real estate, possess expert knowledge related to commercial building leases, and have worked for at least 5 years in a position equivalent to or higher than assistant professor at a recognized research institution. 2. Lawyers, appraisers, certified public accountants, tax accountants, or licensed real estate agents who have worked in their respective fields for at least 5 years and have extensive experience in commercial building lease-related work. 3. Public officials belonging to the senior civil service corps in the Ministry of Economy and Finance responsible for price-related affairs. 4. Public officials belonging to the senior civil service corps in the Ministry of Justice responsible for commercial building lease-related affairs (including special service officials equivalent thereto). 5. Public officials belonging to the senior civil service corps in the Ministry of Land, Infrastructure and Transport responsible for commercial building lease-related affairs. 6. Public officials belonging to the senior civil service corps in the Ministry of SMEs and Startups responsible for small business-related affairs. 7. Persons with extensive knowledge and experience related to commercial building leases, as prescribed by Presidential Decree.

그 밖에 위원회의 구성 및 운영 등에 필요한 사항은 대통령령으로 정한다.

Matters necessary for the composition and operation of the Committee, etc., shall be prescribed by Presidential Decree.
