제25조 약관의 제정 및 변경

금융회사 또는 전자금융업자가 전자금융거래에 관한 약관을 제정하거나 변경하고자 하는 경우에는 미리 금융위원회에 보고하여야 한다. 다만, 이용자의 권익이나 의무에 불리한 영향이 없는 경우로서 금융위원회가 정하는 경우에는 약관의 제정 또는 변경 후 10일 이내에 금융위원회에 보고할 수 있다. <개정 2008.2.29, 2013.5.22>
If a financial company or an electronic finance business operator intends to establish or amend terms and conditions related to electronic financial transactions, it shall report to the Financial Services Commission in advance. Provided, however, that in cases where there is no adverse effect on the rights or obligations of users and as determined by the Financial Services Commission, a report may be made to the Financial Services Commission within 10 days after the establishment or amendment of the terms and conditions. <Amended by Act No. 9423, Feb. 29, 2008; Act No. 11820, May 22, 2013>
금융위원회는 건전한 전자금융거래질서를 유지하기 위하여 필요한 경우에는 금융회사 또는 전자금융업자에 대하여 제1항의 규정에 따른 약관의 변경을 권고할 수 있다. <개정 2008.2.29, 2013.5.22>
The Financial Services Commission may recommend the amendment of terms and conditions pursuant to the provisions of paragraph ① to a financial company or an electronic finance business operator, if deemed necessary to maintain a sound order of electronic financial transactions. <Amended by Act No. 9423, Feb. 29, 2008; Act No. 11820, May 22, 2013>
금융위원회는 제1항의 규정에 따른 약관의 제정 또는 변경에 대한 보고의 시기ㆍ절차 그 밖에 필요한 사항을 정할 수 있다. <개정 2008.2.29>
The Financial Services Commission may prescribe the timing, procedures, and other necessary matters concerning the establishment or amendment of terms and conditions pursuant to the provisions of paragraph ①. <Amended by Act No. 9423, Feb. 29, 2008>
제1항 내지 제3항의 규정은 제2조제3호 다목 및 라목의 금융회사에 대하여는 이를 적용하지 아니한다. <개정 2013.5.22>
The provisions of paragraphs ① to ③ shall not apply to financial companies under Article 2, Subparagraph 3, Item (c) and (d). <Amended by Act No. 11820, May 22, 2013>
