제6조 접근매체의 선정과 사용 및 관리

금융회사 또는 전자금융업자는 전자금융거래를 위하여 접근매체를 선정하여 사용 및 관리하고 이용자의 신원, 권한 및 거래지시의 내용 등을 확인하여야 한다. <개정 2013.5.22>
Financial companies or electronic financial service providers shall select, use, and manage access media for electronic financial transactions, and shall verify the identity, authority, and transaction instructions of users, etc. <Amended by Act No. 11829, May 22, 2013>
금융회사 또는 전자금융업자가 접근매체를 발급할 때에는 이용자의 신청이 있는 경우에 한하여 본인임을 확인한 후에 발급하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 이용자의 신청이나 본인의 확인이 없는 때에도 발급할 수 있다. <개정 2013.5.22>
1. 선불전자지급수단 또는 제16조제1항 단서의 규정에 따른 전자화폐인 경우
2. 접근매체의 갱신 또는 대체발급 등을 위하여 대통령령이 정하는 바에 따라 이용자의 동의를 얻은 경우
When a financial company or electronic financial service provider issues access media, it shall do so only upon the user's request after verifying the user's identity. However, in any of the following cases, access media may be issued even without the user's request or verification of identity: <Amended by Act No. 11829, May 22, 2013> 1. In the case of prepaid electronic payment instruments or electronic currency under the proviso to Article 16 (1); 2. In cases where the user's consent is obtained in accordance with Presidential Decree for renewal or reissuance of access media, etc.
누구든지 접근매체를 사용 및 관리함에 있어서 다른 법률에 특별한 규정이 없는 한 다음 각 호의 행위를 하여서는 아니 된다. 다만, 제18조에 따른 선불전자지급수단이나 전자화폐의 양도 또는 담보제공을 위하여 필요한 경우(제3호의 행위 및 이를 알선ㆍ중개하는 행위는 제외한다)에는 그러하지 아니하다. <개정 2008.12.31, 2015.1.20, 2016.1.27, 2020.5.19>
1. 접근매체를 양도하거나 양수하는 행위
2. 대가를 수수(授受)ㆍ요구 또는 약속하면서 접근매체를 대여받거나 대여하는 행위 또는 보관ㆍ전달ㆍ유통하는 행위
3. 범죄에 이용할 목적으로 또는 범죄에 이용될 것을 알면서 접근매체를 대여받거나 대여하는 행위 또는 보관ㆍ전달ㆍ유통하는 행위
4. 접근매체를 질권의 목적으로 하는 행위
5. 제1호부터 제4호까지의 행위를 알선ㆍ중개ㆍ광고하거나 대가를 수수(授受)ㆍ요구 또는 약속하면서 권유하는 행위
No person shall engage in the following acts when using or managing access media, unless otherwise provided by other laws. However, this shall not apply to cases where it is necessary for the transfer or pledge of prepaid electronic payment instruments or electronic currency under Article 18 (excluding the acts under subparagraph 3 and acts of brokering or mediating such acts): <Amended by Act No. 9324, Dec. 31, 2008; Act No. 13008, Jan. 20, 2015; Act No. 13850, Jan. 27, 2016; Act No. 17281, May 19, 2020> 1. Transferring or acquiring access media; 2. Receiving or lending access media, or storing, delivering, or distributing it, in exchange for receiving, demanding, or promising consideration; 3. Receiving or lending access media, or storing, delivering, or distributing it, for the purpose of using it for a crime or while knowing that it will be used for a crime; 4. Using access media as security for a pledge; 5. Brokering, mediating, or advertising the acts under subparagraphs 1 through 4, or soliciting such acts in exchange for receiving, demanding, or promising consideration.
금융회사ㆍ전자금융업자 및 전자금융보조업자(이하 "금융회사등"이라 한다)가 전자적 장치의 작동오류 등 불가피한 사유로 이용자의 접근매체를 획득한 경우 그 접근매체를 그 이용자에게 반환할 때에는 신분증 제시 요청 등의 방법으로 본인임을 확인할 수 있다. <신설 2020.5.19>
When a financial company, electronic financial service provider, or electronic financial assistant (hereinafter referred to as "financial companies, etc.") obtains a user's access media due to unavoidable reasons such as malfunction of an electronic device, they may verify the user's identity by requesting the presentation of identification, etc., when returning the access media to the user. <Newly Inserted by Act No. 17281, May 19, 2020>
제4항에 따른 본인확인을 요청할 수 있는 사유 및 본인확인 방법은 대통령령으로 정한다. <신설 2020.5.19>
