①

중소기업퇴직연금기금제도는 공단에서 운영한다.

The SME Retirement Pension Fund System shall be operated by the Corporation.

②

중소기업퇴직연금기금제도 운영과 관련한 주요 사항을 심의ㆍ의결하기 위하여 공단에 중소기업퇴직연금기금제도운영위원회(이하 "운영위원회"라 한다)를 둔다.

To deliberate and resolve major matters related to the operation of the SME Retirement Pension Fund System, an SME Retirement Pension Fund System Operation Committee (hereinafter referred to as the "Operation Committee") shall be established within the Corporation.

운영위원회의 위원장은 공단 이사장으로 한다.

The chairperson of the Operation Committee shall be the president of the Corporation.

운영위원회는 위원장, 퇴직연금 관계 업무를 담당하는 고용노동부의 고위공무원단에 속하는 일반직공무원 및 위원장이 위촉하는 다음 각 호의 위원으로 구성한다. 이 경우 위원장을 포함한 위원의 수는 10명 이상 15명 이내로 구성하되, 제2호와 제3호에 해당하는 위원의 수는 같아야 한다.

1. 공단의 상임이사
2. 근로자를 대표하는 사람
3. 사용자를 대표하는 사람
4. 퇴직연금 관련 전문가로서 퇴직연금 및 자산운용에 관한 학식과 경험이 풍부한 사람

The Operation Committee shall be composed of the chairperson, a permanent public official belonging to the Senior Civil Service Corps of the Ministry of Employment and Labor in charge of retirement pension-related affairs, and members appointed by the chairperson under the following subparagraphs. In this case, the total number of members, including the chairperson, shall be between 10 and 15, and the number of members falling under subparagraphs 2 and 3 shall be equal. 1. Standing director of the Corporation 2. Person representing workers 3. Person representing employers 4. Person with extensive knowledge and experience in retirement pensions and asset management as an expert in retirement pensions

제4항제2호부터 제4호까지에 해당하는 사람으로서 위원장이 위촉한 위원의 임기는 3년으로 하되, 연임할 수 있다. 다만, 위원의 사임 등으로 새로 위촉된 위원의 임기는 전임 위원 임기의 남은 기간으로 한다.

The term of office for members appointed by the chairperson under subparagraphs 2 to 4 of paragraph 4 shall be 3 years, and they may be reappointed. However, the term of office for a newly appointed member due to the resignation of a previous member shall be the remaining period of the predecessor's term.

운영위원회는 다음 각 호의 사항을 심의ㆍ의결한다.

1. 중소기업퇴직연금기금 운용계획 및 지침에 관한 사항
2. 제23조의5에 따른 중소기업퇴직연금기금표준계약서의 작성 및 변경에 관한 사항
3. 제23조의6제2항에 따른 수수료 수준에 관한 사항
4. 그 밖에 위원장이 중소기업퇴직연금기금제도 운영과 관련한 주요 사항에 관하여 운영위원회의 회의에 부치는 사항

The Operation Committee shall deliberate and resolve the following matters. 1. Matters concerning the operation plan and guidelines of the SME Retirement Pension Fund 2. Matters concerning the creation and amendment of the SME Retirement Pension Fund Standard Contract under Article 23-5 3. Matters concerning the level of fees under Article 23-6 (2) 4. Other matters that the chairperson refers to the Operation Committee for deliberation and resolution regarding major matters related to the operation of the SME Retirement Pension Fund System

위원장은 중소기업퇴직연금기금 운용 등과 관련하여 운영위원회를 지원하기 위한 자문위원회를 구성할 수 있다.

The chairperson may establish an advisory committee to support the Operation Committee in matters related to the operation of the SME Retirement Pension Fund.

그 밖에 운영위원회의 구성 및 운영 등에 필요한 사항은 대통령령으로 정한다.

Other matters necessary for the composition and operation of the Operation Committee shall be determined by Presidential Decree.
