제15조 피보험자격에 관한 신고 등

사업주는 그 사업에 고용된 근로자의 피보험자격의 취득 및 상실 등에 관한 사항을 대통령령으로 정하는 바에 따라 고용노동부장관에게 신고하여야 한다. <개정 2010.6.4>
The employer shall report to the Minister of Employment and Labor matters concerning the acquisition and loss of insured qualification of workers employed in the business, as prescribed by Presidential Decree. <Amended by 2010.6.4>
고용산재보험료징수법 제9조에 따라 원수급인(元受給人)이 사업주로 된 경우에 그 사업에 종사하는 근로자 중 원수급인이 고용하는 근로자 외의 근로자에 대하여는 그 근로자를 고용하는 다음 각 호의 하수급인(下受給人)이 제1항에 따른 신고를 하여야 한다. 이 경우 원수급인은 고용노동부령으로 정하는 바에 따라 하수급인에 관한 자료를 고용노동부장관에게 제출하여야 한다. <개정 2010.2.4, 2010.6.4, 2011.5.24, 2016.1.19, 2019.4.30, 2021.1.5, 2023.8.8>
1. 「건설산업기본법」 제2조제7호에 따른 건설사업자
2. 「주택법」 제4조에 따른 주택건설사업자
3. 「전기공사업법」 제2조제3호에 따른 공사업자
4. 「정보통신공사업법」 제2조제4호에 따른 정보통신공사업자
5. 「소방시설공사업법」 제2조제1항제2호에 따른 소방시설업자
6. 「국가유산수리 등에 관한 법률」 제14조에 따른 국가유산수리업자
Where the prime contractor is designated as the employer pursuant to Article 9 of the 「Employment and Industrial Accident Compensation Insurance Premium Collection Act」, the subcontractor falling under any of the following subparagraphs, who employs workers for that business other than workers employed by the prime contractor, shall make the report referred to in paragraph ① for such workers. In this case, the prime contractor shall submit data concerning the subcontractors to the Minister of Employment and Labor, as prescribed by the Ordinance of the Ministry of Employment and Labor. <Amended by 2010.2.4, 2010.6.4, 2011.5.24, 2016.1.19, 2019.4.30, 2021.1.5, 2023.8.8> 1. A construction business operator as defined in Article 2, Clause 7 of the 「Framework Act on Construction Industry」 2. A housing construction business operator as defined in Article 4 of the 「Housing Act」 3. A business operator as defined in Article 2, Clause 3 of the 「Electrical Construction Business Act」 4. An information and communication construction business operator as defined in Article 2, Clause 4 of the 「Information and Communication Construction Business Act」 5. A fire-fighting facility business operator as defined in Article 2, Clause 1, Subparagraph 2 of the 「Fire-fighting Facility Business Act」 6. A national heritage repair business operator as defined in Article 14 of the 「Act on the Repair of National Heritage, etc.」
사업주가 제1항에 따른 피보험자격에 관한 사항을 신고하지 아니하면 대통령령으로 정하는 바에 따라 근로자가 신고할 수 있다.
If the employer fails to report matters concerning insured qualification as referred to in paragraph ①, the worker may make the report as prescribed by Presidential Decree.
고용노동부장관은 제1항부터 제3항까지의 규정에 따라 신고된 피보험자격의 취득 및 상실 등에 관한 사항을 고용노동부령으로 정하는 바에 따라 피보험자 및 원수급인 등 관계인에게 알려야 한다. <개정 2010.6.4>
The Minister of Employment and Labor shall inform the insured, the prime contractor, and other related persons of matters concerning the acquisition and loss of insured qualification reported pursuant to paragraphs ① through ③, as prescribed by the Ordinance of the Ministry of Employment and Labor. <Amended by 2010.6.4>
제1항이나 제2항에 따른 사업주, 원수급인 또는 하수급인은 같은 항의 신고를 고용노동부령으로 정하는 전자적 방법으로 할 수 있다. <개정 2010.6.4>
The employer, prime contractor, or subcontractor referred to in paragraph ① or ② may make the report referred to in the same paragraph by electronic means as prescribed by the Ordinance of the Ministry of Employment and Labor. <Amended by 2010.6.4>
고용노동부장관은 제5항에 따라 전자적 방법으로 신고를 하려는 사업주, 원수급인 또는 하수급인에게 고용노동부령으로 정하는 바에 따라 필요한 장비 등을 지원할 수 있다. <개정 2010.6.4>
The Minister of Employment and Labor may provide necessary equipment, etc., to the employer, prime contractor, or subcontractor intending to report by electronic means pursuant to paragraph ⑤, as prescribed by the Ordinance of the Ministry of Employment and Labor. <Amended by 2010.6.4>
제1항에도 불구하고 자영업자인 피보험자는 피보험자격의 취득 및 상실에 관한 신고를 하지 아니한다. <신설 2011.7.21>
