제21조(벌칙) 제16조의 규정을 위반하여 근로자에게 불리한 처우를 한 자는 2년 이하의 징역 또는 1천만원 이하의 벌금에 처한다.

① A person who has treated a worker unfavorably in violation of the provisions of Article 16 shall be punished by imprisonment for not more than two years or a fine not exceeding 10 million won.
