이 법은 상시 5인 이상의 근로자를 사용하는 모든 사업 또는 사업장에 적용한다. 다만, 동거의 친족만을 사용하는 사업 또는 사업장과 가사사용인에 대하여는 적용하지 아니한다.
This Act shall apply to all businesses or workplaces that regularly employ five or more workers. However, this Act shall not apply to businesses or workplaces that employ only cohabiting relatives, or to domestic workers.
상시 4인 이하의 근로자를 사용하는 사업 또는 사업장에 대하여는 대통령령으로 정하는 바에 따라 이 법의 일부 규정을 적용할 수 있다. <개정 2020.5.26>
This Act may apply, in part, to businesses or workplaces that regularly employ four or fewer workers, as prescribed by Presidential Decree. <Amended by Act No. 17316, May 26, 2020>
국가 및 지방자치단체의 기관에 대하여는 상시 사용하는 근로자의 수와 관계없이 이 법을 적용한다. <개정 2020.5.26>
