재정경제부장관은 이 법을 적용받는 자가 다음 각 호의 어느 하나에 해당하는 경우에는 경고를 할 수 있다. <개정 2025.10.1>
1. 제15조부터 제18조까지의 규정에 따라 허가를 받거나 신고를 한 경우 허가사항 또는 신고사항에 정하여진 기한이 지난 후에 거래 또는 행위를 한 경우
2. 대통령령으로 정하는 금액(거래 또는 행위 유형에 따라 금액을 달리 정할 수 있다) 이하의 거래 또는 행위로서 제15조부터 제18조까지의 규정에 따른 절차 준수, 허가 또는 신고(이하 "신고등"이라 한다)의 의무를 위반하여 거래 또는 행위를 한 경우
The Minister of Finance and Economy may issue a warning to a person subject to this Act if the person falls under any of the following subparagraphs. <Amended on 2025.10.1> 1. Where a person, after obtaining permission or filing a report under Articles 15 through 18, conducts a transaction or act after the expiration of the deadline prescribed in the permission or report. 2. Where a person conducts a transaction or act that falls below the amount prescribed by Presidential Decree (the amount may be set differently depending on the type of transaction or act), and violates the duty to comply with the procedures under Articles 15 through 18, or the duty to obtain permission or file a report (hereinafter referred to as "report, etc.") when conducting the transaction or act.
재정경제부장관은 이 법을 적용받는 자의 거래 또는 행위가 제15조부터 제18조까지의 규정에 따른 신고등의 의무를 5년 이내에 2회 이상 위반한 경우에는 각각의 위반행위에 대하여 1년 이내의 범위에서 관련 외국환거래 또는 행위를 정지ㆍ제한하거나 허가를 취소할 수 있다. <개정 2017.1.17, 2025.10.1>
If a person subject to this Act violates the duty of report, etc. under Articles 15 through 18 two or more times within five years, the Minister of Finance and Economy may suspend or restrict related foreign exchange transactions or acts, or revoke permission, within the scope of one year for each violation. <Amended on 2017.1.17, 2025.10.1>
재정경제부장관은 제2항에 따른 처분을 하려는 경우에는 청문을 하여야 한다. <개정 2025.10.1>
When the Minister of Finance and Economy intends to impose a disposition under paragraph (2), a hearing shall be held. <Amended on 2025.10.1>
제1항 또는 제2항에 따른 처분에 필요한 사항은 대통령령으로 정한다.
Matters necessary for dispositions under paragraph (1) or (2) shall be prescribed by Presidential Decree.
