제32조 과태료

다음 각 호의 어느 하나에 해당하는 자에게는 1억원 이하의 과태료를 부과한다. 다만, 제29조에 해당하는 경우는 제외한다. <개정 2011.4.30, 2016.3.2, 2017.1.17, 2025.3.18>
1. 제8조제4항에 따른 변경신고를 하지 아니하거나 거짓으로 변경신고를 하고 외국환업무를 한 자
2. 제9조제1항 후단에 따른 변경신고를 하지 아니하거나 거짓으로 변경신고를 하고 외국환중개업무를 한 자 또는 같은 조 제2항을 위반하여 외국환중개업무를 한 자
3. 제16조에 따른 신고를 하지 아니하거나 거짓으로 신고를 하고 지급 또는 수령을 한 자
3의2. 삭제<2017.1.17>
4. 제18조제1항에 따른 신고를 하지 아니하거나 거짓으로 신고를 하고 자본거래를 한 자
5. 제18조제5항을 위반하여 신고수리가 거부되었음에도 그 신고에 해당하는 자본거래를 한 자
6. 제18조제6항을 위반하여 같은 조 제4항제3호의 권고내용과 달리 자본거래를 한 자
Any person falling under any of the following subparagraphs shall be subject to a disciplinary fine of not more than 100 million won. However, this shall not apply to cases falling under Article 29. <Amended by Act No. 12504, Apr. 30, 2011, Act No. 14083, Mar. 2, 2016, Act No. 14520, Jan. 17, 2017, Act No. XXXX, Mar. 18, 2025> 1. A person who has engaged in foreign exchange business without filing a change report under Article 8 (4), or who has filed a false change report and engaged in foreign exchange business. 2. A person who has engaged in foreign exchange brokerage business without filing a change report under the latter part of Article 9 (1), or who has filed a false change report and engaged in foreign exchange brokerage business, or a person who has engaged in foreign exchange brokerage business in violation of the same Article (2). 3. A person who has made a payment or receipt without filing a report under Article 16, or who has filed a false report and made a payment or receipt. 3.2. Deleted <Jan. 17, 2017> 4. A person who has engaged in a capital transaction without filing a report under Article 18 (1), or who has filed a false report and engaged in a capital transaction. 5. A person who has engaged in a capital transaction corresponding to a report, despite the report having been refused under Article 18 (5) and in violation of the same provision. 6. A person who has engaged in a capital transaction in a manner different from the recommendations under Article 18 (4) 3., in violation of Article 18 (6).
다음 각 호의 어느 하나에 해당하는 자에게는 5천만원 이하의 과태료를 부과한다. 다만, 제29조에 해당하는 경우는 제외한다. <신설 2017.1.17>
1. 제11조의3제5항에 따른 자료를 제출하지 아니하거나 거짓으로 제출한 자
2. 제15조제1항에 따른 지급절차 등을 위반하여 지급ㆍ수령을 하거나 자금을 이동시킨 자
3. 제17조에 따른 신고를 하지 아니하거나 거짓으로 신고를 하고 지급수단 또는 증권을 수출입하거나 수출입하려 한 자
Any person falling under any of the following subparagraphs shall be subject to a disciplinary fine of not more than 50 million won. However, this shall not apply to cases falling under Article 29. <Newly established Jan. 17, 2017> 1. A person who has failed to submit, or has submitted false, data under Article 11-3 (5). 2. A person who has made a payment, received payment, or transferred funds in violation of the payment procedures, etc. under Article 15 (1). 3. A person who has attempted to export or import payment instruments or securities without filing a report under Article 17, or who has filed a false report and attempted to export or import payment instruments or securities.
다음 각 호의 어느 하나에 해당하는 자에게는 3천만원 이하의 과태료를 부과한다. <개정 2017.1.17, 2025.10.1>
1. 제16조 또는 제18조를 위반하여 신고를 갈음하는 사후 보고를 하지 아니하거나 거짓으로 사후 보고를 한 자
2. 제20조제3항 또는 제6항에 따른 검사에 응하지 아니하거나 검사를 거부ㆍ방해 또는 기피한 자
3. 제20조제5항 또는 제6항에 따른 시정명령에 따르지 아니한 자
4. 제21조에 따른 재정경제부장관의 명령을 위반하여 통보 또는 제공을 하지 아니하거나 거짓으로 통보 또는 제공한 자
Any person falling under any of the following subparagraphs shall be subject to a disciplinary fine of not more than 30 million won. <Amended by Act No. 14520, Jan. 17, 2017, Act No. YYYY, Oct. 1, 2025> 1. A person who has failed to file a post-reporting in lieu of reporting under Article 16 or Article 18, or who has filed a false post-reporting. 2. A person who has failed to respond to an inspection under Article 20 (3) or (6), or who has refused, obstructed, or evaded an inspection. 3. A person who has failed to comply with a corrective order under Article 20 (5) or (6). 4. A person who has failed to provide notification or information, or who has provided false notification or information, in violation of the Minister of Economy and Finance's order under Article 21.
다음 각 호의 어느 하나에 해당하는 자에게는 1천만원 이하의 과태료를 부과한다. <신설 2017.1.17, 2025.10.1>
1. 제8조제4항에 따른 폐지신고를 하지 아니한 자
2. 제9조제3항에 따른 신고를 하지 아니한 자
3. 제19조제1항에 따른 경고를 받고 2년 이내에 경고 사유에 해당하는 위반행위를 한 자
4. 제20조제1항 또는 제2항에 따른 보고 또는 자료 제출을 하지 아니하거나 거짓으로 보고 또는 자료 제출을 한 자
5. 제20조제4항 또는 제6항에 따른 자료를 제출하지 아니하거나 거짓으로 자료 제출을 한 자
6. 제24조제2항에 따른 재정경제부장관의 명령을 위반하여 신고, 신청, 보고, 자료의 통보 및 제출을 전자문서의 방법으로 하지 아니한 자
Any person falling under any of the following subparagraphs shall be subject to a disciplinary fine of not more than 10 million won. <Newly established Jan. 17, 2017, Act No. YYYY, Oct. 1, 2025> 1. A person who has failed to file a report of termination under Article 8 (4). 2. A person who has failed to file a report under Article 9 (3). 3. A person who, after receiving a warning under Article 19 (1), has committed a violation corresponding to the reason for the warning within two years. 4. A person who has failed to submit a report or data, or who has submitted a false report or data, under Article 20 (1) or (2). 5. A person who has failed to submit data, or who has submitted false data, under Article 20 (4) or (6). 6. A person who has failed to submit a report, application, report, or data via electronic means, in violation of the Minister of Economy and Finance's order under Article 24 (2).
제1항부터 제4항까지의 규정에 따른 과태료는 대통령령으로 정하는 바에 따라 재정경제부장관이 부과ㆍ징수한다. <개정 2017.1.17, 2025.10.1>
