제79조의3 보호 일시해제 심사기준

청장ㆍ사무소장ㆍ출장소장 또는 보호소장이 법 제65조제1항에 따라 직권으로 보호를 일시해제하거나 외국인보호위원회가 같은 조 제2항에 따라 보호의 일시해제 신청에 대해 결정을 하는 경우에는 다음 각 호의 사항을 심사해야 한다. <개정 2018.5.8, 2018.9.18, 2025.5.27>
1. 피보호자의 생명ㆍ신체에 중대한 위협이나 회복할 수 없는 재산상 손해가 발생할 우려가 있는지 여부
2. 국가안전보장ㆍ사회질서ㆍ공중보건 등의 국익을 해칠 우려가 있는지 여부
3. 피보호자의 범법사실ㆍ연령ㆍ품성, 조사과정 및 보호시설에서의 생활태도
4. 도주할 우려가 있는지 여부
5. 그 밖에 중대한 인도적 사유가 있는지 여부
When the head of the Immigration Office, the head of an office, the head of a branch office, or the head of a detention facility temporarily releases a person from detention ex officio pursuant to Article 65(1) of the Act, or when the Foreigner Protection Committee decides on a request for temporary release from detention pursuant to Article 65(2) of the Act, they shall review the following matters. <Amended on May 8, 2018, September 18, 2018, May 27, 2025> 1. Whether there is a risk of serious threat to the life or body of the detained person or irreparable property damage 2. Whether there is a risk of harming the national interest, such as national security, social order, or public health 3. The detained person's illegal acts, age, character, the investigation process, and their attitude while living in the detention facility 4. Whether there is a risk of absconding 5. Whether there are other serious humanitarian grounds
제1항에 따른 청장ㆍ사무소장ㆍ출장소장 또는 보호소장의 보호 일시해제 결정의 세부 기준과 방법에 관한 사항은 법무부장관이, 외국인보호위원회의 보호 일시해제 신청에 대한 결정의 세부 기준과 방법에 관한 사항은 외국인보호위원회가 정한다. <개정 2025.5.27>
The Minister of Justice shall determine the detailed criteria and methods for the decision on temporary release from detention by the head of the Immigration Office, the head of an office, the head of a branch office, or the head of a detention facility under paragraph ①, and the Foreigner Protection Committee shall determine the detailed criteria and methods for the decision on a request for temporary release from detention by the Foreigner Protection Committee. <Amended on May 27, 2025>
