Article 80-5 (Request for Supplementation by the Foreigner Protection Committee, etc.)
제80조의5 외국인보호위원회의 보완 요구 등

외국인보호위원회는 다음 각 호의 서류에 미비사항이 있는 경우에는 보완기간을 정하여 피보호자(피보호자의 보증인 또는 법정대리인등을 포함한다. 이하 이 조, 제80조의6제1항 및 제80조의7에서 같다), 청장ㆍ사무소장ㆍ출장소장 또는 보호소장에게 보완을 요구할 수 있다. 다만, 경미한 사항은 외국인보호위원회가 직권으로 보완할 수 있다.
1. 제69조제1항에 따른 심사청구서(첨부자료를 포함한다)
2. 제69조제2항에 따른 의견서
3. 제78조제2항 본문에 따른 보호기간 연장 승인신청서(첨부자료를 포함한다)
4. 제79조의2제1항에 따른 보호 일시해제 신청서(첨부자료를 포함한다)
5. 제79조의2제2항에 따른 의견서
If there are any deficiencies in the documents listed in the following subparagraphs, the Foreigner Protection Committee may set a period for supplementation and request the person seeking protection (including the guarantor or legal representative of the person seeking protection, hereinafter the same in this Article and Articles 80-6(1) and 80-7), the Commissioner, the head of the office, the head of the branch office, or the head of the protection facility to supplement them. However, for minor matters, the Foreigner Protection Committee may supplement them ex officio. 1. Application for review under Article 69(1) (including attached documents) 2. Statement of opinion under Article 69(2) 3. Application for approval of extension of protection period under the main sentence of Article 78(2) (including attached documents) 4. Application for temporary release from protection under Article 79-2(1) (including attached documents) 5. Statement of opinion under Article 79-2(2)
제1항 본문에 따른 피보호자에 대한 보완 요구는 청장ㆍ사무소장ㆍ출장소장 또는 보호소장을 거쳐서 할 수 있다.
A request for supplementation to the person seeking protection under the main sentence of paragraph ① may be made through the Commissioner, the head of the office, the head of the branch office, or the head of the protection facility.
제2항에 따라 청장ㆍ사무소장ㆍ출장소장 또는 보호소장을 통해 보완을 요구받은 피보호자는 그 보완기간 내에 보완자료를 청장ㆍ사무소장ㆍ출장소장 또는 보호소장에게 제출해야 한다. 이 경우 청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 해당 보완자료를 지체 없이 외국인보호위원회에 보내야 한다.
A person seeking protection who has received a request for supplementation through the Commissioner, the head of the office, the head of the branch office, or the head of the protection facility pursuant to paragraph ② shall submit the supplementary materials to the Commissioner, the head of the office, the head of the branch office, or the head of the protection facility within the period for supplementation. In this case, the Commissioner, the head of the office, the head of the branch office, or the head of the protection facility shall promptly send the supplementary materials to the Foreigner Protection Committee.
제1항 본문에 따라 보완을 요구받은 피보호자(제2항에 따라 청장ㆍ사무소장ㆍ출장소장 또는 보호소장을 통해 보완을 요구받은 피보호자는 제외한다), 청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 그 보완기간 내에 보완자료를 외국인보호위원회에 제출해야 한다.
The person seeking protection who has received a request for supplementation pursuant to the main sentence of paragraph ① (excluding a person seeking protection who has received a request for supplementation through the Commissioner, the head of the office, the head of the branch office, or the head of the protection facility pursuant to paragraph ②), the Commissioner, the head of the office, the head of the branch office, or the head of the protection facility shall submit the supplementary materials to the Foreigner Protection Committee within the period for supplementation.
제1항 본문에 따라 피보호자에게 보완 요구를 하여 그 보완에 걸린 기간은 제70조제1항 또는 제79조의2제3항에 따른 결정기간에 포함하지 않는다.
The period taken for supplementation after the person seeking protection has been requested to supplement pursuant to the main sentence of paragraph ① shall not be included in the decision period pursuant to Article 70(1) or Article 79-2(3).
