제96조 권한의 위임

법무부장관은 법 제92조제1항에 따라 법 제7조제1항, 제7조의3제1항, 제9조, 제10조의3제3항, 제11조, 제20조, 제21조, 제23조부터 제25조까지, 제25조의2, 제25조의5, 제30조제1항, 제39조, 제78조제2항, 제79조의2제2항, 제79조의3, 제81조의3제2항ㆍ제4항, 제89조, 제89조의2, 제90조, 제90조의2 및 제91조의2에 따른 그의 권한을 법무부령으로 정하는 바에 따라 청장ㆍ사무소장ㆍ출장소장 또는 보호소장에게 위임한다. <개정 2013.5.31, 2013.6.21, 2015.6.15, 2016.7.5, 2016.9.29, 2018.5.8, 2018.9.18, 2019.12.24, 2020.8.5, 2020.12.8, 2022.12.27>
The Minister of Justice shall, pursuant to Article 92 (1) of this Act, delegate his authority under Articles 7 (1), 7-3 (1), 9, 10-3 (3), 11, 20, 21, 23 through 25, 25-2, 25-5, 30 (1), 39, 78 (2), 79-2 (2), 79-3, 81-3 (2) and (4), 89, 89-2, 90, 90-2, and 91-2 of this Act, to the heads of bureaus, offices, branches, or shelters, as prescribed by a Presidential Decree.
시장(특별시장 및 광역시장은 제외한다)은 법 제92조제2항에 따라 법 제34조제2항에 따른 그의 권한을 구청장(자치구의 구청장은 제외한다)에게 위임한다. <개정 2016.9.29>
A mayor (excluding a metropolitan mayor and a special city mayor) shall, pursuant to Article 92 (2) of this Act, delegate his authority under Article 34 (2) of this Act to the head of a district office (excluding the head of a self-governing district office).
외국인보호위원회는 법 제92조제3항에 따라 다음 각 호의 권한을 위원장에게 위임한다. <신설 2025.5.27>
1. 법 제66조의12제5항에 따른 구술심리 신청에 대한 허가 여부의 결정
2. 제70조제1항 단서에 따른 심사청구에 대한 결정기간의 연장
3. 제78조제2항 단서에 따른 보호기간 연장 승인 신청기간에 대한 협의
4. 제79조의2제3항 단서에 따른 보호 일시해제 신청에 대한 결정기간의 연장
The Foreigner Protection Committee shall, pursuant to Article 92 (3) of this Act, delegate the following authorities to the chairperson: 1. Decision on whether to grant permission for an oral hearing application under Article 66-12 (5) of this Act. 2. Extension of the decision period for a review request under the proviso to Article 70 (1). 3. Consultation on the application period for the extension of the protection period under the proviso to Article 78 (2). 4. Extension of the decision period for an application for temporary lifting of protection under the proviso to Article 79-2 (3).
