Article 39-3 (Persons Subject to Departure Suspension)
제39조의3 출국정지 대상자

법 제4조제1항제7호 및 제29조제1항에 따라 출국을 정지할 수 있는 대상자는 다음 각 호의 어느 하나에 해당하는 외국인으로 한다. <개정 2020.12.10, 2022.4.12, 2025.5.30>
1. 2억원 이상의 국세를 포탈한 혐의로 세무조사를 받고 있는 사람
2. 20억원 이상의 허위 세금계산서 또는 계산서를 발행한 혐의로 세무조사를 받고 있는 사람
3. 공중보건에 현저한 위해를 끼칠 염려가 있다고 법무부장관이 인정하는 사람
4. 「전자장치 부착 등에 관한 법률」 제13조에 따라 위치추적 전자장치가 부착된 사람
5. 그 밖에 출국 시 국가안보 또는 외교관계를 현저하게 해칠 우려가 있다고 법무부장관이 인정하는 사람
A person subject to departure suspension under Article 4(1) subparas. 7 and Article 29(1) shall be an alien falling under any of the following subparagraphs. <Amended by Act No. 17779, Dec. 10, 2020; Act No. 18144, Apr. 12, 2022; Act No. 19539, May 30, 2025> 1. A person undergoing a tax investigation on suspicion of evading national taxes of 200 million won or more. 2. A person undergoing a tax investigation on suspicion of issuing false tax invoices or calculation statements worth 2 billion won or more. 3. A person recognized by the Minister of Justice as likely to cause significant harm to public health. 4. A person to whom an electronic tracking device is attached under Article 13 of the Act on the Attachment of Electronic Devices, etc. 5. Any other person recognized by the Minister of Justice as likely to significantly harm national security or diplomatic relations if they depart the country.
법 제4조제2항 및 제29조제1항에 따라 출국을 정지할 수 있는 대상자는 사형, 무기, 장기 3년 이상의 징역 또는 금고에 해당하는 범죄 혐의로 수사를 받고 있거나 그 소재를 알 수 없어서 기소중지 또는 수사중지(피의자중지로 한정한다)가 된 외국인으로 한다. <개정 2020.12.31>
A person subject to departure suspension under Article 4(2) and Article 29(1) shall be an alien who is under investigation for a crime punishable by death, life imprisonment, or imprisonment or confinement for not less than three years, or whose whereabouts are unknown and who has been subject to suspension of prosecution or suspension of investigation (limited to suspension of the suspect). <Amended by Act No. 17797, Dec. 31, 2020>
