법 제30조제1항 단서에서 "법무부령으로 정하는 사람"이란 다음 각 호와 같다. 다만, 법 제11조에 따라 입국이 금지되는 외국인과 이 규칙 제10조 각 호의 어느 하나에 해당하는 사람은 제외한다. <개정 2010.11.16, 2011.12.23, 2018.9.21>
1. 영 별표 1의3 체류자격 영주(F-5)의 자격을 가진 사람으로서 출국한 날부터 2년 이내에 재입국하려는 사람
2. 영 별표 1의2 중 체류자격 1. 외교(A-1)부터 25. 동반(F-3)까지, 27. 결혼이민(F-6)부터 30. 기타(G-1)까지의 자격을 가진 사람으로서 출국한 날부터 1년(남아 있는 체류기간이 1년보다 짧을 경우에는 남아있는 체류기간으로 한다) 이내에 재입국하려는 사람
The "person prescribed by Presidential Decree" in the proviso to Article 30 (1) of the Act refers to the following: Provided, That any foreigner whose entry is prohibited under Article 11 and any person falling under any of the subparagraphs of Article 10 of this Rule shall be excluded. <Amended on Nov. 16, 2010; Dec. 23, 2011; Sep. 21, 2018> 1. A person who has the status of residence of permanent sojourn (F-5) as specified in Annex Table 1-3 of the Presidential Decree, and who intends to re-enter within two years from the date of departure. 2. A person who has a status of residence as specified in Annex Table 1-2 of the Presidential Decree, from diplomatic (A-1) to accompanying (F-3), and from marriage immigrant (F-6) to other (G-1), and who intends to re-enter within one year from the date of departure (if the remaining period of stay is less than one year, the remaining period of stay shall apply). <Amended on Nov. 16, 2010>

제1항에 해당하는 사람에 대한 재입국허가면제기간 연장에 관하여는 제39조의8을 준용한다. <개정 2018.9.21>
Article 39-8 shall apply mutatis mutandis to the extension of the period of exemption from re-entry permit for a person falling under paragraph (1). <Amended on Sep. 21, 2018>
