제6조의8 출국금지결정 등 통지의 예외

법 제4조의4제3항제1호에 따라 대한민국의 안전 또는 공공의 이익에 중대하고 명백한 위해를 끼칠 우려가 있어 출국금지나 출국금지기간 연장의 통지를 하지 아니할 수 있는 경우는 출국이 금지된 사람이 다음 각 호의 어느 하나에 해당하는 죄와 관련된 혐의자인 경우로 한정한다. <개정 2015.6.15>
1. 「형법」 중 내란ㆍ외환의 죄
2. 「국가보안법」 위반의 죄
3. 「군형법」 중 반란ㆍ이적의 죄
4. 「군형법」 중 군사기밀 누설죄와 암호부정 사용죄
The cases where notification of departure prohibition or extension of departure prohibition period may not be made due to the risk of causing grave and manifest danger to the safety of the Republic of Korea or the public interest, pursuant to Article 4-4(3)1 of the Act, shall be limited to cases where the person whose departure is prohibited is a suspect in a crime falling under any of the following subparagraphs. <Amended by Act No. 13343, Jun. 15, 2015> 1. Crimes of rebellion or foreign aggression under the 「Criminal Act」 2. Crimes of violating the 「National Security Act」 3. Crimes of rebellion or treason under the 「Military Criminal Act」 4. Crimes of leaking military secrets and unauthorized use of codes under the 「Military Criminal Act」
영 제2조의2제2항에 따른 출국금지 요청기관의 장은 영 제3조의3제1항에 따라 당사자에게 통지하지 아니할 것을 요청하는 경우에는 출국금지 요청서의 출국금지 사유란 또는 출국금지기간 연장요청서의 연장요청 사유란에 그 이유를 기재하여야 한다.
The head of a departure prohibition requesting agency, pursuant to Article 2-2(2) of the Enforcement Decree, when requesting not to notify the party concerned under Article 3-3(1) of the Enforcement Decree, shall state the reason in the departure prohibition reason column of the departure prohibition request form or the extension request reason column of the extension request form.
법무부장관은 영 제3조의3제2항에 따라 출국금지 또는 출국금지기간 연장을 결정한 사실을 통지하지 아니하기로 한 경우에는 출국금지 등의 심사결정서에 그 이유를 기재하여야 한다.
The Minister of Justice, when deciding not to notify the fact that departure prohibition or extension of departure prohibition period has been decided, pursuant to Article 3-3(2) of the Enforcement Decree, shall state the reason in the decision on examination of departure prohibition, etc.
