Article 63-3 (Procedure for Transfer Order to Protected Person)
제63조의3 피보호자에 대한 이송명령의 절차

법무부장관은 법 제63조제4항(법 제63조의3제2항에서 준용하는 경우를 포함한다)에 따라 피보호자를 다른 보호시설로 이송을 명하려는 경우에는 해당 피보호자의 인적사항과 이송사유 등을 적은 서면(전자문서를 포함한다)을 다음 각 호에 해당하는 청장ㆍ사무소장ㆍ출장소장 또는 보호소장에게 모두 보내야 한다.
1. 영 제78조제1항에 따라 피보호자에게 보호명령서를 발급한 청장ㆍ사무소장ㆍ출장소장 또는 보호소장
2. 이송할 피보호자를 보호하고 있는 청장ㆍ사무소장ㆍ출장소장 또는 보호소장
3. 이송된 피보호자를 보호할 청장ㆍ사무소장ㆍ출장소장 또는 보호소장
When the Minister of Justice intends to order the transfer of a protected person to another detention facility pursuant to Article 63(4) (including cases applied mutatis mutandis by Article 63-3(2)), the Minister of Justice shall send a written document (including electronic documents) stating the personal details and reasons for transfer of the protected person to all of the Directors of Regional Bureaus, Directors of Branch Offices, Directors of Field Offices, or Directors of Detention Facilities falling under the following subparagraphs. 1. Directors of Regional Bureaus, Directors of Branch Offices, Directors of Field Offices, or Directors of Detention Facilities who issued a detention order to the protected person pursuant to Article 78(1) of the Enforcement Decree. 2. Directors of Regional Bureaus, Directors of Branch Offices, Directors of Field Offices, or Directors of Detention Facilities who are holding the protected person to be transferred. 3. Directors of Regional Bureaus, Directors of Branch Offices, Directors of Field Offices, or Directors of Detention Facilities who will hold the protected person after transfer.
제1항에 따라 이송명령을 받은 제1항제2호 및 제3호의 청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 해당 피보호자를 지체 없이 인계ㆍ인수하고 그 사실을 법무부장관에게 보고해야 한다.
The Directors of Regional Bureaus, Directors of Branch Offices, Directors of Field Offices, or Directors of Detention Facilities referred to in subparagraphs 2 and 3 of paragraph ① who have received a transfer order pursuant to paragraph ① shall immediately transfer and receive the protected person, and report such fact to the Minister of Justice.
