Article 9 (Delegation of Visa Issuance Authority)

제9조 사증발급권한의 위임

①

영 제11조제2항에 따라 법무부장관이 재외공관의 장에게 위임하는 사증발급 권한(영 제7조의2제4항에 따른 전자사증 발급권한은 제외한다)은 다음 각 호와 같다. <개정 2009.4.3, 2011.12.23, 2013.1.1, 2018.9.21, 2022.12.29>

  1. 1. 다음 각 목에 해당하는 사증 발급(이 경우에는 입국 후에 체류자격 변경을 허가하지 아니한다는 뜻을 신청인에게 알려야 한다)

    1. 가. 영 별표 1 중 체류자격 3. 일시취재(C-1)ㆍ5. 단기취업(C-4)의 자격에 해당하는 사람에 대한 체류기간 90일 이하의 단수사증
    2. 나. 복수사증발급협정 등이 체결된 국가의 경우 영 별표 1 중 체류자격 3. 일시취재(C-1)의 자격에 해당하는 사람에 대한 체류기간 90일 이하의 사증
    3. 다. 영 별표 1 중 체류자격 단기방문(C-3)의 자격에 해당하는 사람에 대한 체류기간 90일 이하의 사증

  2. 2. 영 별표 1의2 중 체류자격 5. 유학(D-2)의 자격에 해당하는 사람에 대한 체류기간 2년 이하의 단수사증 발급 및 13. 구직(D-10)의 자격에 해당하는 사람에 대한 체류기간 6개월 이하의 단수사증 발급

  3. 3. 영 별표 1의2 중 체류자격 11. 기업투자(D-8)의 자격에 해당하는 사람과 그 동반가족[체류자격 25. 동반(F-3)]에 대한 체류기간 1년 이하의 단수사증 발급

  4. 4. 「경제자유구역의 지정 및 운영에 관한 법률」 제4조에 따라 지정된 경제자유구역에 투자한 자로서 영 별표 1의2 중 체류자격 11. 기업투자(D-8) 가목의 자격에 해당하는 사람과 그 동반가족[체류자격 25. 동반(F-3)]에 대한 체류기간 2년 이하의 사증 발급

  5. 5. 영 별표 1의2 중 체류자격 26. 재외동포(F-4)의 자격에 해당하는 사람에 대한 체류기간 2년 이하의 사증 발급

  6. 6. 별표 1의3 영주(F-5)의 자격에 해당하는 사람에 대한 단수사증 발급

  7. 7. 영 별표 1의2 중 체류자격 28. 관광취업(H-1)의 자격에 해당하는 사람에 대한 체류기간 1년 이하의 사증 발급

  8. 8. 영 별표 1의2 중 체류자격 29. 방문취업(H-2)의 자격에 해당하는 사람에 대한 체류기간 1년 이하의 사증 발급

  9. 9. 그 밖에 영 별표 1의2의 체류자격 중 다음 각 목의 체류자격에 해당하는 사람으로서 상호주의 또는 대한민국의 이익 등을 위하여 법무부장관이 특히 필요하다고 인정하는 사람에 대한 체류기간 1년 이하의 사증 발급

    1. 가. 4. 문화예술(D-1)
    2. 나. 6. 기술연수(D-3) 및 7. 일반연수(D-4)
    3. 다. 8. 취재(D-5) 부터 10. 주재(D-7)까지 및 12. 무역경영(D-9)
    4. 라. 14. 교수(E-1)부터 20. 특정활동(E-7)까지
    5. 마. 20의2. 계절근로(E-8), 21. 비전문취업(E-9) 및 22. 선원취업(E-10)
    6. 바. 23. 방문동거(F-1)부터 25. 동반(F-3)까지 및 27. 결혼이민(F-6)
    7. 사. 30. 기타(G-1)

The visa issuance authority delegated by the Minister of Justice to the head of a diplomatic mission abroad pursuant to Article 11(2) of the Presidential Decree (excluding the electronic visa issuance authority under Article 7(2)4 of the Presidential Decree) shall be as follows. <Amended by Act No. 2009.4.3, 2011.12.23, 2013.1.1, 2018.9.21, 2022.12.29> 1. Issuance of visas corresponding to the following subparagraphs (in this case, the applicant shall be informed that change of sojourn status after entry will not be permitted): a. Single-entry visa with a period of sojourn of not more than 90 days for persons falling under the status of sojourn 3. Temporary Research (C-1) and 5. Short-term Employment (C-4) in Annex Table 1 of the Presidential Decree. b. Visa with a period of sojourn of not more than 90 days for persons falling under the status of sojourn 3. Temporary Research (C-1) in Annex Table 1 of the Presidential Decree, in the case of countries with which a multiple-entry visa issuance agreement has been concluded, etc. c. Visa with a period of sojourn of not more than 90 days for persons falling under the status of sojourn Short-term Visit (C-3) in Annex Table 1 of the Presidential Decree. 2. Issuance of a single-entry visa with a period of sojourn of not more than 2 years for persons falling under the status of sojourn 5. Study Abroad (D-2) in Annex Table 1-2 of the Presidential Decree, and issuance of a single-entry visa with a period of sojourn of not more than 6 months for persons falling under the status of sojourn 12. Job Seeking (D-10) in Annex Table 1-2 of the Presidential Decree. 3. Issuance of a single-entry visa with a period of sojourn of not more than 1 year for persons falling under the status of sojourn 11. Enterprise Investment (D-8) in Annex Table 1-2 of the Presidential Decree and their accompanying family members (status of sojourn 25. Companion (F-3)). 4. Issuance of a visa with a period of sojourn of not more than 2 years for persons who have invested in an economic free zone designated under Article 4 of the 「Act on the Designation and Management of Economic Free Zones」 and fall under the status of sojourn 11. Enterprise Investment (D-8) subparagraph a in Annex Table 1-2 of the Presidential Decree, and their accompanying family members (status of sojourn 25. Companion (F-3)). 5. Issuance of a visa with a period of sojourn of not more than 2 years for persons falling under the status of sojourn 26. Overseas Koreans (F-4) in Annex Table 1-2 of the Presidential Decree. 6. Issuance of a single-entry visa for persons falling under the status of sojourn Permanent Residence (F-5) in Annex Table 1-3. 7. Issuance of a visa with a period of sojourn of not more than 1 year for persons falling under the status of sojourn 28. Working Holiday (H-1) in Annex Table 1-2 of the Presidential Decree. 8. Issuance of a visa with a period of sojourn of not more than 1 year for persons falling under the status of sojourn 29. Visiting Employment (H-2) in Annex Table 1-2 of the Presidential Decree. 9. Issuance of a visa with a period of sojourn of not more than 1 year for persons falling under the statuses of sojourn listed in the following subparagraphs in Annex Table 1-2 of the Presidential Decree, who are deemed particularly necessary by the Minister of Justice for reasons of reciprocity or the benefit of the Republic of Korea: a. 4. Culture and Arts (D-1) b. 6. Technical Training (D-3) and 7. General Training (D-4) c. 8. Coverage (D-5) through 10. Professor (D-7) and 12. Trade Management (D-9) d. 14. Professor (E-1) through 20. Specific Activities (E-7) e. 20-2. Seasonal Worker (E-8), 21. Non-professional Employment (E-9), and 22. Seafarer Employment (E-10) f. 23. Visiting Family Member (F-1) through 25. Companion (F-3), and 27. Marriage Migrant (F-6) g. 30. Other (G-1)

법무부장관은 제1항 각 호에 따른 사증의 종류, 체류자격, 체류기간 또는 사증발급 대상 및 절차 등에 관한 세부기준을 정할 수 있다. <개정 2013.1.1>

The Minister of Justice may establish detailed standards regarding the types of visas, statuses of sojourn, periods of sojourn, or the subjects and procedures for visa issuance under subparagraphs of paragraph 1. <Amended by Act No. 2013.1.1>
