Article 23 (Granting of a Status of Stay)

다음 각 호의 어느 하나에 해당하는 외국인이 제10조에 따른 체류자격을 가지지 못하고 대한민국에 체류하게 되는 경우에는 다음 각 호의 구분에 따른 기간 이내에 대통령령으로 정하는 바에 따라 체류자격을 받아야 한다.
1. 대한민국에서 출생한 외국인: 출생한 날부터 90일
2. 대한민국에서 체류 중 대한민국의 국적을 상실하거나 이탈하는 등 그 밖의 사유가 발생한 외국인: 그 사유가 발생한 날부터 60일
Where a foreign national falling under any of the following comes to stay in the Republic of Korea without holding a status of stay under Article 10, they shall obtain a status of stay within the period specified below, as prescribed by Presidential Decree: 1. A foreign national born in the Republic of Korea: within 90 days from the date of birth 2. A foreign national in whose case another ground has arisen while staying in the Republic of Korea, such as the loss or renunciation of the nationality of the Republic of Korea: within 60 days from the date the ground arose
제1항에 따른 체류자격 부여의 심사기준은 법무부령으로 정한다.
The criteria for examining the granting of a status of stay under paragraph (1) shall be prescribed by Ordinance of the Ministry of Justice.
