제94조 벌칙

1. 제3조제1항을 위반하여 출국심사를 받지 아니하고 출국한 사람
2. 제7조제1항 또는 제4항을 위반하여 입국한 사람
3. 제7조의2를 위반한 사람
4. 제12조의3을 위반한 사람으로서 제93조의2제2항 또는 제93조의3제1호ㆍ제3호에 해당하지 아니하는 사람
5. 제14조제1항에 따른 승무원 상륙허가 또는 제14조의2제1항에 따른 관광상륙허가를 받지 아니하고 상륙한 사람
6. 제14조제3항에 따른 승무원 상륙허가 또는 제14조의2제3항에 따른 관광상륙허가의 조건을 위반한 사람
7. 제17조제1항을 위반하여 체류자격이나 체류기간의 범위를 벗어나서 체류한 사람
8. 제18조제1항을 위반하여 취업활동을 할 수 있는 체류자격을 받지 아니하고 취업활동을 한 사람
9. 제18조제3항을 위반하여 취업활동을 할 수 있는 체류자격을 가지지 아니한 사람을 고용한 사람
10. 제18조제4항을 위반하여 취업활동을 할 수 있는 체류자격을 가지지 아니한 외국인의 고용을 업으로 알선ㆍ권유한 사람
11. 제18조제5항을 위반하여 체류자격을 가지지 아니한 외국인을 자기 지배하에 두는 행위를 한 사람
11의2. 제19조의5제9항을 위반하여 계절근로자의 선발, 알선 및 채용에 개입하는 행위를 한 사람
12. 제20조를 위반하여 체류자격 외 활동허가를 받지 아니하고 다른 체류자격에 해당하는 활동을 한 사람
13. 제21조제2항을 위반하여 근무처의 변경허가 또는 추가허가를 받지 아니한 외국인의 고용을 업으로 알선한 사람
14. 제22조에 따른 제한 등을 위반한 사람
15. 제23조를 위반하여 체류자격을 받지 아니하고 체류한 사람
16. 제24조를 위반하여 체류자격 변경허가를 받지 아니하고 다른 체류자격에 해당하는 활동을 한 사람
17. 제25조를 위반하여 체류기간 연장허가를 받지 아니하고 체류기간을 초과하여 계속 체류한 사람
17의2. 제26조를 위반한 사람
18. 제28조제1항이나 제2항을 위반하여 출국심사를 받지 아니하고 출국한 사람
19. 제33조의3을 위반한 사람
20. 제69조(제70조제1항 및 제2항에서 준용하는 경우를 포함한다)를 위반한 사람
A person falling under any of the following shall be punished by imprisonment with labour for not more than three years or by a fine not exceeding 30 million won: <Amended on Jan. 26, 2012; Jan. 7, 2014; Mar. 29, 2016; Mar. 20, 2018; Apr. 23, 2019; Mar. 24, 2020; Jul. 22, 2025> 1. A person who has departed without undergoing departure inspection, in violation of Article 3 (1) 2. A person who has entered the country in violation of Article 7 (1) or (4) 3. A person who has violated Article 7-2 4. A person who has violated Article 12-3 and does not fall under Article 93-2 (2) or subparagraph 1 or 3 of Article 93-3 5. A person who has landed without a crew landing permit under Article 14 (1) or a tourist landing permit under Article 14-2 (1) 6. A person who has violated a condition of a crew landing permit under Article 14 (3) or of a tourist landing permit under Article 14-2 (3) 7. A person who has stayed beyond the scope of their status of stay or period of stay, in violation of Article 17 (1) 8. A person who has engaged in employment activities without obtaining a status of stay permitting employment activities, in violation of Article 18 (1) 9. A person who has employed a person not holding a status of stay permitting employment activities, in violation of Article 18 (3) 10. A person who has, as a business, arranged or solicited the employment of a foreign national not holding a status of stay permitting employment activities, in violation of Article 18 (4) 11. A person who has placed under their control a foreign national not holding a status of stay, in violation of Article 18 (5) 11-2. A person who has intervened in the selection, arrangement or recruitment of seasonal workers, in violation of Article 19-5 (9) 12. A person who has engaged in activities corresponding to another status of stay without obtaining permission for activities not covered by their status of stay, in violation of Article 20 13. A person who has, as a business, arranged the employment of a foreign national who has not obtained permission to change or add a place of employment, in violation of Article 21 (2) 14. A person who has violated a restriction or other requirement under Article 22 15. A person who has stayed without obtaining a status of stay, in violation of Article 23 16. A person who has engaged in activities corresponding to another status of stay without obtaining permission to change their status of stay, in violation of Article 24 17. A person who has continued to stay beyond their period of stay without obtaining permission to extend it, in violation of Article 25 17-2. A person who has violated Article 26 18. A person who has departed without undergoing departure inspection, in violation of Article 28 (1) or (2) 19. A person who has violated Article 33-3 20. A person who has violated Article 69 (including where applied mutatis mutandis under Article 70 (1) and (2))
