1. 「난민법」 제2조제1호에 규정된 이유로 그 생명ㆍ신체 또는 신체의 자유를 침해받을 공포가 있는 영역으로부터 직접 입국하거나 상륙한 난민이라는 사실
2. 제1호의 공포로 인하여 해당 위반행위를 한 사실
