제44조 산재보험 의료기관에 대한 과징금 등

공단은 제43조제3항제1호ㆍ제2호 및 같은 조 제5항제1호 중 어느 하나에 해당하는 사유로 진료제한 조치를 하여야 하는 경우로서 그 진료제한 조치가 그 산재보험 의료기관을 이용하는 근로자에게 심한 불편을 주거나 그 밖에 특별한 사유가 있다고 인정되면, 그 진료제한 조치를 갈음하여 거짓이나 부정한 방법으로 지급하게 한 보험급여의 금액 또는 거짓이나 부정ㆍ부당하게 지급받은 진료비의 5배 이하의 범위에서 과징금을 부과할 수 있다. <개정 2010.1.27>

When the Corporation must impose treatment restriction measures due to any of the grounds falling under Article 43 (3) 1. or 2., and Article 43 (5) 1., and if it is recognized that such treatment restriction measures would cause severe inconvenience to workers using the industrial accident insurance medical institution or if there are other special reasons, the Corporation may impose an administrative fine within a range not exceeding five times the amount of insurance benefits paid through fraudulent or dishonest means or medical expenses paid fraudulently, dishonestly, or improperly, in lieu of the treatment restriction measures. <Amended by Act No. 9973, Jan. 27, 2010>

제1항에 따라 과징금을 부과하는 위반행위의 종류와 위반정도 등에 따른 과징금의 금액 등에 관한 사항은 대통령령으로 정한다.

Matters concerning the amount of administrative fines, etc., according to the type and degree of violation of the act of violation for which administrative fines are imposed under paragraph (1), shall be determined by Presidential Decree.

제1항에 따라 과징금 부과 처분을 받은 자가 과징금을 기한 내에 내지 아니하면 고용노동부장관의 승인을 받아 국세 체납처분의 예에 따라 징수한다. <개정 2010.1.27, 2010.6.4>
