간병급여는 제40조에 따른 요양급여를 받은 사람 중 치유 후 의학적으로 상시 또는 수시로 간병이 필요하여 실제로 간병을 받는 사람에게 지급한다. <개정 2020.5.26>

A caregiving benefit shall be paid to a person who has received a treatment benefit under Article 40, who medically requires constant or occasional caregiving after healing and is actually receiving caregiving.

제1항에 따른 간병급여의 지급 기준과 지급 방법 등에 관하여 필요한 사항은 대통령령으로 정한다.

Matters necessary for the standards and methods of payment for the caregiving benefit under paragraph ① shall be determined by Presidential Decree.
