Article 79 (Special Survivor Benefit)
제79조 유족특별급여

보험가입자의 고의 또는 과실로 발생한 업무상의 재해로 근로자가 사망한 경우에 수급권자가 「민법」에 따른 손해배상청구를 갈음하여 유족특별급여를 청구하면 제62조의 유족급여 또는 제91조의4의 진폐유족연금 외에 대통령령으로 정하는 유족특별급여를 지급할 수 있다. <개정 2010.5.20>
Where a worker dies from an occupational accident caused by the intentional act or negligence of an insured person, if a beneficiary claims a special survivor benefit in lieu of a claim for damages under the Civil Act, a special survivor benefit as prescribed by Presidential Decree may be paid in addition to the survivor benefit under Article 62 or the survivor pension for pneumoconiosis under Article 91-4. <Amended by Act No. 10338, May 20, 2010>
유족특별급여에 관하여는 제78조제1항 단서ㆍ제2항 및 제3항을 준용한다. 이 경우 "장해특별급여"는 "유족특별급여"로 본다.
The proviso to Article 78(1), and Articles 78(2) and 78(3) shall apply mutatis mutandis to the special survivor benefit. In this case, "special disability benefit" shall be deemed "special survivor benefit".
