제91조의11 진폐에 따른 사망원인의 확인 등

분진작업에 종사하고 있거나 종사하였던 근로자의 사망원인을 알 수 없는 경우에 그 유족은 해당 근로자가 진폐 등으로 사망하였는지 여부에 대하여 확인하기 위하여 병리학 전문의가 있는 산재보험 의료기관 중에서 공단이 지정하는 의료기관에 전신해부에 대한 동의서를 첨부하여 해당 근로자의 시신에 대한 전신해부를 의뢰할 수 있다. 이 경우 그 의료기관은 「시체 해부 및 보존 등에 관한 법률」 제2조에도 불구하고 전신해부를 할 수 있다. <개정 2020.4.7>
In cases where the cause of death of a worker who is or was engaged in dust-related work is unknown, the bereaved family may request a whole-body autopsy of the worker's body from a medical institution designated by the Corporation among industrial accident insurance medical institutions with a pathologist, by attaching a consent form for whole-body autopsy. In this case, the medical institution may perform a whole-body autopsy notwithstanding Article 2 of the Act on Dissection and Preservation of Corpses, etc. <Amended by Act No. 17249, Apr. 7, 2020>
공단은 제1항에 따라 전신해부를 실시한 의료기관 또는 유족에게 그 비용의 전부 또는 일부를 지원할 수 있다. 이 경우 비용의 지급기준 및 첨부서류 제출, 그 밖에 비용지원 절차에 관한 사항은 고용노동부령으로 정한다. <개정 2010.6.4>
The Corporation may support all or part of the expenses for a medical institution that performs a whole-body autopsy or for the bereaved family, pursuant to Paragraph ①. In this case, the standards for payment of expenses, submission of supporting documents, and other matters concerning the procedure for expense support shall be prescribed by the Ordinance of the Ministry of Employment and Labor. <Amended by Act No. 10337, Jun. 4, 2010>
