제91조의8 진폐판정 및 보험급여의 결정 등

공단은 제91조의6에 따라 진단결과를 받으면 진폐심사회의의 심사를 거쳐 해당 근로자의 진폐병형, 합병증의 유무 및 종류, 심폐기능의 정도 등을 판정(이하 "진폐판정"이라 한다)하여야 한다. 이 경우 진폐판정에 필요한 기준은 대통령령으로 정한다.
Upon receiving the diagnostic results pursuant to Article 91-6, the Corporation shall, after deliberation by the Pneumoconiosis Review Committee, determine the pneumoconiosis stage, the presence and type of complications, the degree of cardiopulmonary function, etc. of the relevant worker (hereinafter referred to as "Pneumoconiosis Determination"). In this case, the standards necessary for Pneumoconiosis Determination shall be prescribed by Presidential Decree.
공단은 제1항의 진폐판정 결과에 따라 요양급여의 지급 여부, 진폐장해등급과 그에 따른 진폐보상연금의 지급 여부 등을 결정하여야 한다. 이 경우 진폐장해등급 기준 및 합병증 등에 따른 요양대상인정기준은 대통령령으로 정한다.
Based on the results of the Pneumoconiosis Determination under paragraph ①, the Corporation shall decide whether to pay medical benefits, the pneumoconiosis disability grade and whether to pay pneumoconiosis compensation pensions accordingly. 공단은 합병증 등으로 심폐기능의 정도를 판정하기 곤란한 진폐근로자에 대하여는 제2항의 진폐장해등급 기준에도 불구하고 진폐병형을 고려하여 진폐장해등급을 결정한다. 이 경우 진폐장해등급 기준은 대통령령으로 정한다.
For workers with pneumoconiosis for whom it is difficult to determine the degree of cardiopulmonary function due to complications, etc., the Corporation shall determine the pneumoconiosis disability grade considering the pneumoconiosis stage, notwithstanding the pneumoconiosis disability grade criteria under paragraph ②. In this case, the criteria for pneumoconiosis disability grades shall be prescribed by Presidential Decree.
공단은 제2항 및 제3항에 따라 보험급여의 지급 여부 등을 결정하면 그 내용을 해당 근로자에게 알려야 한다.
