1. 구제명령을 이행하기 위하여 사용자가 객관적으로 노력하였으나 근로자의 소재불명 등으로 구제명령을 이행하기 어려운 것이 명백한 경우
2. 천재ㆍ사변, 그 밖의 부득이한 사유로 구제명령을 이행하기 어려운 경우
