Article 43-6 (Request for Provision of Data, etc. for Public Disclosure of Unpaid Employer Lists, etc.)

The Minister of Employment and Labor may request the provision of data or the use of related computer networks (hereinafter referred to as "provision of data, etc.") falling under any of the following subparagraphs from the persons specified in each subparagraph, in order to carry out tasks related to the public disclosure of unpaid employer lists under Article 43-2, the provision of data on unpaid wages, etc. under Article 43-3, and the restriction of assistance and support from heads of central administrative agencies, etc. to habitual unpaid employers under Article 43-4. 1. To the President of the Supreme Court's Office: The corporate registration certificate of the unpaid employer. 2. To the Commissioner of the National Tax Service: Data on comprehensive income under Article 4 (1) 1 of the Income Tax Act, data on income under Article 4 (1) 1 of the Corporate Tax Act, and data on business registration under Article 8 of the Value-Added Tax Act, Article 111 of the Corporate Tax Act, and Article 168 of the Income Tax Act, of the unpaid employer. 3. To the Commissioner of the National Tax Service: Data on comprehensive income under Article 4 (1) 1 of the Income Tax Act of the worker to whom wages, etc. are unpaid. 4. To the Korea Workers' Compensation and Welfare Service: Data on average monthly wages under Article 16-3 of the Act on the Collection of Insurance Premiums for Employment Insurance and Industrial Accident Compensation Insurance, data on acquisition of insured status under Articles 13 and 15 of the Employment Insurance Act, and data on advance payments under Articles 7, 7-2, and 8 of the Wage Claims Guarantee Act of the unpaid employer.

Any person who has received a request for provision of data, etc. under paragraph 1 shall comply with the request unless there is a justifiable reason.
