제97조(위반의 효력) 취업규칙에서 정한 기준에 미달하는 근로조건을 정한 근로계약은 그 부분에 관하여는 무효로 한다. 이 경우 무효로 된 부분은 취업규칙에 정한 기준에 따른다.
Translation
① A labor contract that stipulates working conditions lower than the standards prescribed by the rules of employment shall be void to the extent of such stipulation. In such case, the void part shall be governed by the standards prescribed by the rules of employment.
