1. 다음 각 목의 요건을 모두 갖춘 미성년자
- 가. 제41조제1항에 따른 소득의 합이 연간 100만원 이하일 것
- 나. 제42조제1항제1호에 해당하는 재산이 없을 것
2. 부모가 모두 사망한 미성년자로서 제1호가목의 요건을 갖춘 미성년자
